Busted with Heroin
Hi SWIM was in court a couple of weeks ago and recieved a fine of £270 for a possesion of heroin (2 x TB's) charge that happened nearly a year ago.
Fast forward to today, SWIM had just scored a half gram of H when he got busted again, it was the same undercover wanker polis, SWIM was even wearing the same clothes as last time. Fuck, it was like a carbon copy. Anyway SWIM co-operated and they let him go agin after charging him in the car, he told them a slightly lower price than what he had paid for it when asked. Has any SWIMmers been in a similar situation? As SWIM is thinking he might end up actually getting a sentance, do you think its likely or maybe get fined again...?This is scotland by the way |

swim wouldnt think there would be a sentence for such a small amount, then again she doesnt know how things work in scotland. do they penalize people for possession of small amounts normally?

Swim thinks its will be a hefty fine, but no sentance for swiy. Of course, just conjecture.
Swim's been googling around and all he can find related to swiy's situation is cocaine possession in scotland. But swim quotes from a scottish government website for class A possession: Up to 7 years in prison or an unlimited fine. Or both. So, guess it could go either way, although a hefty fine would be more likely than a prison sentance. |

would be helpful to try rehabilitation of some sort in the meantime, just in case it goes to court. judges are more sympathetic to people who become clean before the hearing, or who are willing to become clean, or those who go onto methadone/buprenorphine maintenance and can provide urine samples that are clean of heroin.

Depends if it goes to magistrates or a crown court. Magistrates more likely to prosecute but will get a fine/small sentence (months) whereas in crown court one is more likely to be aquitted but if one is sentenced is likely to receive a harsher punishment. Sounds like you'll be going to magistrates for this kind of offence.
The system is usually lenient providing you agree to enlist on some form of rehabilitation or maintainance program. Hope this has helped. |
