In Australia I was arrested for a summary offence. I did it, not going to deny it, dont care about it. I was charged... yadda yadda yadda... a few weeks later i had an appointment with my lawyer, I happen to unfortunaly live 200metres away from the police station and went in to get the summary of the offences and brief of evidence for my lawyer...
When i arrived, the informant; a Constable, asked me if he could ask me a few questions in relation to further summary offences (bullshit) I told him that i had the appointment with my lawyer and said I'd talk to him another time, he told me it wouldn't take long so i stupidly agreed and followed him through the glass door into the reception area of the station... it was here that he told me what these further summary charges were and i knew it would take long. I know legally the police are not able to hold me for questioning so i told him i was leaving... went towards the glass door. he pushed me into the glass door and told me that i wasn't leaving, at this time further police officers exited the offices into the reception area and saw me pinned up against the glass. i was told to get on the ground by one of those officers, i walked to an area where i could actually get on the ground and knelt down, i was then pushed onto my stomach and the police officers jumped on my back, instictivly i put my hands infront of me to catch my fall and they were pinned benith my chest. when i was asked to put my hands behind my back i couldn't because of the weight of the officers pushing on the back of my head and shoulders. I was left with bruises etc etc. I was then told I was under arrest and read my rights...
I was handcuffed and moved into an interview room. i was then frisked without even being asked/ told it was going to happen. and then my shoes were forcably removed causing pain on my recently reconstructed foot.
I was pretty angry at this stage. I was left in the interview room for two hours, was not allowed to make a phone call have a drink go to the toilet or anything, everytime i asked they laughed. In conversation i told them that i had had an appointment with my psychiatrist that morning, again they laughed. at this stage two hours after my arrest they didn't even have a statement from the alleged victim (who i can assure you is the biggest liar in the world) and no evidence. They decided to transfer me under 'section ten' (mental health act) to the local hospital giving them some time to actually take a statement and gather evidence.
On my return the sergeant who had just started his shit came to visit me in the interview room and proceeded to tell me that i was just an upstart kid and that i needed to respect the police etc etc etc... i replied that just because he had completed less then six months training and wore a badge made him no more a man then me.
Trust me i think it hurt his feelings. in the presence of other police officers he threatened me, i calmly but rather smartassishly replied "is that a threat" he returned with "you can take it any way you like" so i then replied "well in that case, why dont i just find out your address when i get out of here, is that a threat? you can take that anyway you like" the officers then left the room. by this stage it was 6 hours since i had been arrested, i had not been given access to a phone, anything to eat or drink. I then pushed the alert button in the interview room to get some attention considering i was being ignored. a couple of officers entered the room and i asked them when i could see a lawyer, they stated once they had compleated their investigations, i told them that they should let me go considering it's just a summary offence until they get their act together. the sergeant who had earlier made threats told me that they can take as long as they want. they then turned to exit the room and i said "you're a prick you know that" once the other officers had exited the room he closed the door and came up to the seat i was sitting on, he then grabbed me by the neck and slammed my head against the wall three times and punched me in the face twice, i was left bleeding, swollen and bruised. He then left. I was then finally interviewed 8 hours after i had been arrested, during the interview to my shock the charges layed out to me included resisting arrest and making threats to kill the police officer! after the interview the sergeant came to tell me a bail justice had arrived to see if i could get bail, he then noticed my swollen lip and asked me what i had in my mouth. i told him thats where he had hit me. he looked at the other officers in the room and then sarcastically said "dont know what you're talking about".
I was bailed out and am set to go to court on the 22nd of july, again charged with the summary offences and now resisting arrest and making threats to kill...
RIDICULOUS.
and of course the police stick together and concoct a bs story to cover their asses leaving me no hope to beat those charges in court.
I however did call the informant and recorded my telephone conversation with him, the recording clearly has him stating that he knew that i didn;t make threats to kill the sergeant and that i was assulted. Unfortunaly when i told him i had recorded the conversation he said if i used it as evidence then i could be charged with some form of telecommunications law. but i think it will be worth it to prove how bs the police were.
luckily i've also learnt my lesson, i'll never walk into a police station under my own free will ever again.
