Legally high? Legal considerations of Salvia divinorum

File Archive
A new entry has been added to Law

Description:
O. Hayden Griffin III, Bryan Lee Miller and David N. Khey. Journal of Psychoactive Drugs 40.2 (June 2008): p183(9).

The legal status of the hallucinogenic plant Salvia divinorum has been rapidly changing. Legal prohibitions on this plant native to Oaxaca, Mexico have emerged at the state level, a phenomenon that has not occurred since the passage of the Controlled Substances Act (CSA). Included will be a brief description of the plant that has only recently crept into the popular American consciousness, and a review of the different legal mechanisms through which states have controlled the plant and the pending legislation proposing controls. Lastly, the implications of various state laws are discussed.

Re: Legally high? Legal considerations of Salvia divinorum

If people understood salvia they would realize that it's not a big problem. I mean, from what I've heard, it only lasts like 5 mins and you probably couldn't even get to a car to drive while on it, let alone get up to do anything. IMO it's not dangerous at all. About the only damage that I could see arising from the use of salvia is falling down and getting a bruise ya know?

Here in Michigan the police may arrest you for driving while intoxicated, impaired, or under the influence...of most anything. I don't condone driving while under the effect of any substance but a legal system with such latitude can be downright scary. As an example, if the police even suspect a driver is under the influence the driver loses the right to deny a police search of their vehicle and person.
