Smoking Blend Legality in USA

Does anyone have an updated list of the legality of smoking blends in the US?

SWIM is most interested to know if Magic Silver is illegal, for he has been denied shipment of such blends into the US by some online shops, but not all.

And, if illegal, what schedule would it be classified under? Would it be considered some sort of Cannabis analogue?

evil has read repeatedly that the blends are very much in a grey area, they should be legal, but noone will really know till someone gets busted for it, and has to go to court. which hopefully never happens. evil has never heard of anyone being charged in the usa for ordering, or possession.

evil has read of spice blends being seized.

evil has been ordering his blends from usa based sellers / makers. only once did he unknowingly order from outside the country.

probably not the definative yes or no you were looking for, but evil is not sure if a diffinetive answer exists, maybe other swimmers do.

The Customs and Border Protection (CBP) - Chicago Laboratory (Illinois) recently received five small, resealable, bright foil packets containing dull olive-colored plant material(s), labelled as “Spice Gold,” “Spice Silver,” “Spice Diamond,” “Genie,” and “Yucatan Fire” incense (see Photo 1, right, and Photos 2 - 3, next page), all reputedly laced with various synthetic cannabinoids or synthetic cannabinoid mimicking compounds, notably “HU-210” [(6aR,10aR)-9-(hydroxymethyl)-6,6-dimethyl-3-(2-methyloctan-2-yl)-6a,7,10,10a-tetrahydrobenzo[c]chromen-1-ol); see Figure 1, next page]. The exhibits were selected from a shipment containing approximately 1,500 such packets that were detained by a CBP agricultural specialist at an express parcel service hub in Wilmington, Ohio. The items were not smuggled but were rather part of a formal entry. Standard marijuana analyses (microscopy) of the materials were negative. Analysis of extracts by GC/MS in the scan mode with split injection indicated only the presence of a large amount of vitamin E and other, smaller amounts of various natural products. However, when the extracts were derivatized with N,O-bis(trimethylsilyl)acetamide and injected splitless with selected ion monitoring, HU-210 was found in very small but verifiable amounts in every packet (not quantitated). Due to the labeling practices of the manufacturers, I cannot. You may find some lab results in these forums or elsewhere on the web, but with spice for example, some lab reports allegedly found one synthetic cannibinoid and other lab reports identify another. Whether the labs are at fault, or the manufacturers change ingredients I do not know.

I wonder how the defense of not knowing what was in one's incense would fare in court.

Well, here in Germany they tested many of the smoking blends. Even the same product often had different content. They found Spice Diamond with JWH-018, but before that they had packets of Diamond where they couldn´t find it or any other compund (of course they tested not for all). On other packages they found HU-210 instead of JWH-018. Further they also tested packages which contained several, different types of cannabinoids.

So you never ever know what they put into the stuff. That´s why Spice generally is taken away by the police in the USA. Also the USA got a strong law with analoques, so I think they will bust you for Spice, no matter what is in there.

Oh and Swim mentioned to cook or eat Smoking Blends. Yes you can eat am all, no one of them hast to be cooked or heated like THC. THC is in the plantmaterial in an acid form, your body can´t do anything with it, after heaating the substance changes a little bit, but enough for your body to work with. So Swim can just eat all of the Blends, since the containing cannabinoids are allready in a working form.

Swim tried it, Swim said the double dosage of the smoked stuf will do well. So if SWIM regular smokes 100-200 mg of the Blend in a bong, he has to eat 200-400 mg of the same Blend for similar strong effects. Also Swim mentioned eating lasts longer.
