I thought it was called "Possession" for a reason.

About a month ago #1, #2, and #3 were at a party. #1 and #2 are male, and #3 a female. The party seems to get way out of hand and the PD shows up. The officers were allowed into the residence for some reason and they smell the MJ. They ask to search #1's room OR they'll bring the dogs in and search the entire house. Well, #1 complied with option A. As the PD searches the room he finds some paraphenailia (SP) with residue in them. #1 said it wasn't his, but it belongs to the people that threw it in here while the PD was waiting outside. The PD asks about empty bags, still #1 said they were not his. The PD asked #1 if he had used MJ, and #1 said he had smoked a J earlier. The PD asked #1 if they could pat-search him, #1 complied. The PD patted #1 down, but #1 didn't have anything on his person. #3 on the other hand was asked the same exact questions, with the same exact answers, #2 the same. It ends up #1, and #2 getting charged with SPOM (Simple Possession of MJ.) And #3 gets off scop free. Does that sound right to you?
