GBL disaster (UK LAW HELP!)
I am requesting legal advice for a friend of mine.
SWIM works in IT, has a large range of cleaning products, including CRT/flatscreen screen cleaners, wipes, various de-stickying liquids and GBL for cleaning computer parts, stripping things down and making laptops sparkle like new. Regardless of whether you believe that these products are for legitimate purposes (they are - the only one you can get high from is GBL) SWIM has had a lot of these laying around for various cleaning situations and in the *last week* discovered that GBL is actually consumable!!! SWIM took a hit the night before, enjoyed it and left the diluted water plus GBL liquid in his room. Long story short, SWIMs incredibly messy bedroom contains a load of old food plates and empty glasses. - CAN YOU SEE WHERE THIS IS GOING - SWIM IS A FREAKIN' MORON SWIM woke up parched, drank the nearest glass and set off for work. SWIM has never driven on drugs, alcohol or any other substace he/she is extremely careful and has had no prior dealings with the law at all. About 3 hours later (so the story goes) SWIM was awoken in the middle of the road, engine still running, police everywhere and a paramedic asking questions, blur--blur---blur, woke up in hospital tubes out of every appendage. Nobody was injured during the event thank god. Discharged from hospital after only an hour of coming completely back to normal - straight into police custardy who extracted a blood sample approx 6-7 hours after ingestion to determine if prosecution for driving under the influence is proceedable. To my calculations, this would leave very little trace of the GBL? But not sure. SWIM also has to contact the driving authority (DVLA) to explain that a seisure took place - which would prevent SWIM from driving for a year. I am convinced this was not a seizure - but myoclonic jerks experienced in the GBL sleep state. SWIM has booked a discussion with a GP to explain the situation and hopefully be able to confirm that no seizure took place. The worst of all this however is the police officer at the time SWIM was in the ambulance, asked a lot of questions then asked SWIM to sign his notebook. Apparently SWIM told the police officer he/she had voluntarily taken the liquid an hour previously. (Though due to amnesia, slipping in and out of consiousness and general total disorientation SWIM had no idea what the time was - and why the HELL would SWIM get in a car on a dose of GBL) Assuming the blood test results come back with GBL in - which it may, even if miniscule. What are the potential legal outcomes, and does accidental ingestion of a cleaning product hold any defense? Especially when this ass-cop got SWIM to admit to taking a drug in a delirious state. |
