I am having some doubts which need to be cleared on this section:
PART I (5) Every person who contravenes subsection (1) where the subject matter ofOFFENCES AND PUNISHMENT the offence is a substance included in Schedule II in an amount that does not exceed the amount set out for that substance in Schedule VIII is guilty of an offence punishable on summary conviction and liable to a fine not exceeding one thousand dollars or to imprisonment for a term not exceeding six months, or to both. And SCHEDULE VIII (Sections 4 and 60) Substance Amount 1. Cannabis resin I g 2. Cannabis (marihuana) 30 g I am a noob at law, but my interpretation is that if you only posess < 1g of Cannabis. It is legal? |

I don't think it's legal but I doubt they would lay a charge likely just confiscate it. Of course if one was to get mouthy who knows. As I type,technically it is illegal. Correct me if I am wrong. That is my understanding.

Norman14: If the total amount of weed is BELOW the schedule VIII threshold (does not exceed it) the person is "guilty of an offence". They can still be jailed for up to six months or fined up to CAN$1000. No quantity of marijuana is legal for possession.
Above this threshold much higher penalties apply, and the case may be indictable rather than summary (ie tried in a superior court by jury.) |
