I have never had any first hand experience with any of this, but I was curious about the answers to the following issues. First of all does a person on probation or parole have any real constitutional rights or can they and their property be searched at will? Also what about roomates or family members living in the same house or apartment? For example if a probabtion officer wanted to search around would his right to search only extend to the property of the person on probation? I assume a roomates bed room would be off limits, but what about something like some drawers or a bookcase in a common room? Also people on probation and parole can not own or be in possesion of things like fire arms. But does this prohibition also extend to people he/she may be living with? For example would a room mate or family member have to get rid of or store such items at another location? |

Ok, I know this is a "me too!" post, but yeah, what if my probation officer comes over to do a home visit, can he search anything? Is it like, "Can I see what's in that box there?", then when you say no, thenthat's probable cause to get a search warrant? I'm in possession of legal smoking alternative. My probation rules say "no alcoholic beverages, narcotics, or habit forming drugs." It's a stretch, but maybe they could give me trouble about"habit forming," or would become the reason they rewrite the f*king rules. So I plan to not have my herbal alternatives in plain sight. Somebody tell us thier experiences with this matter please.

I have first hand experience with Juvenile probation and second hand experience with Adult probation/parole
basically your rights go down the drain. You are your Po’s Bitch. they can basically find a reason to lock you up unless you keep your nose very clean. if your on Juvenile probation. Any member of law can search your person or possessions at any time but not your family members so find a non common place (a place you shouldn't have access to like a family members or roommates room). If your walking down the street and get rolled up on and they find out your on probation, you will be searched and fucked with. don’t get very fucked up on alcohol and roll around or hang in sketchy situations, like after a fight, gunshots, alcohol poisoning call and the like. you cannot own firearms or knives or anything dangerous. if you live on your own don’t do shit that will be smelled or found if they walk in the door. if you are in possession of anything legal, then they legally cannot do shit. I ordered an ounce of salvia and other legal seeds, it came right at a probation meeting at my house it was opened and my PO basically had it opened and just wrote down the names of the items. to sum it all up, you cannot hide shit in your room or possessions, they don’t need a warrant of any kind. you cannot carry around weapons you will be arrested you can carry around legal herbs and such just make sure its not something that a normal person could get arrested for. one more piece of advice. If you want to stay out of trouble dont smoke pot, under any curcumstances, you will test positive and if they want to they will take you in.
if you dont get tested daily and feel ballsy you can do coke/meth or opiads once. if you don't do it everyday you can get away with oxycordone (oxycontin)because oxycordone does not turn into morphine in the body. |

Your PO is the one with the power to decide whether you have violated your probation or not. Your personal relationship with your PO matters a lot from what I have experienced. A lot of people on probation end up blowing off their appointments which ends up being a violation. If you are arrested on a drug charge and do urine drops regularly, do not use! If you drop dirty this is considered a violation of probation. You will end up back in court and they consider this as you thumbing your nose at them giving you a second chance. I have sat in the courtroom of violation court and I'll tell ya.... the majority of people that violate probation end up doin time. I wouldn't risk being around anyone with a firearm. I'd ask them nicely to get it away from your presence until you probation is over. As long as you attend you appointments and stay clean, a person will have no problem completing probation. Missed appointments seems to be the number one violation secondary to not paying fines and dirty drops.
