Salvia Laws Confusion
SWIM is new to Salvia and really wanted to try it legally, but when he went to order some leaves the company told him that salvia divinorum was now illegal in Mississippi. According to many sites, the law states, "Effective July 1 2008, Salvia divinorum has been added to Mississippi's list of Schedule I controlled substances, making it illegal to buy, sell, or possess (see text of SB 2456, bill history). The law does not specifically mention salvinorin A. (thanks BH, SLL, A1)" I am not sure if that means that SWIM can purchase the salvia extract and not the leaves. I know that you can purchase pure salvinorin A with a license, but ha SWIM doesn't have a license and don't forsee ever getting one. Any advice would be helpful. By the way I have talked to many companies but they are willing to sell SWIM the leaves too, and I know that is illegal, so I just need to know what's legal and what's not. Thank you.

Please Swim. It is safer.
The thing is that even though there may be loopholes in the law a company would be making an error to use those loopholes in a state where Salvia was illegal. And yes the extract would be illegal if Salvia is. It is still Salvia as I see it. I would never take that risk. If a company is willing to ship a schedule 1 substance into a state where it is illegal I would not touch that company with a 100 foot pole. They are crazy. Now depending on how the law reads ordering a tincture might skirt the law. But still the authorities and courts ultimately interpret the law either narrowly or broadly. Thus I would be tempted to stay away from Salvia in any state where it was illegal and in any form. Regardless of one's attempt to interpret it. |

No, a tincature or even pure chemical, is going to fall under the "analog acts", and you'll get the shit kicked out of you by a violent gang of men wearing blue clothes.
Remember, it doesn't matter how a law in interpreted by a smart person, it's the dumb enforcers who count. By the time you get to make your argument in front of a judge, you'll have regretted it. |

True, but do you think a cop is going to listen to logic like that? The problem nobody sees, is that the word "salvia" on the package is going to be enough to end up arrested. You may escape charges come your court date, but it's not going to be fun waiting around for that.

Well, I don't want to get too far off topic, but because I cannot "safely" purchase salvia in any form, is there any legal alternative that is very similar to salvia? I cannot for the life of me find one when I search online. I've looked at 5-meo-dmt but that seems a little dangerous and difficult to use, and the legality seems sketchy. Any advice would be helpful, thank you for your quick responses.

So, SWIPC want to try Salvia, but finds it illegal in Mississippi.
Does SWIPC travel at all? Ever leave the state? Considering that there's plenty of US states that still allow the open sale of Salvia, a road trip may be in order. After all, Mississippi lacks the authority to tell its citizenry what to do when outside its borders. For all one knows, one might not even like it. (Note that I'm NOT advising crossing state line with it, etc, just a weekend away.) |

Swim thinks that is a valid point and he should attempt that, he is in fact going to florida in May. He would still like to know if there is a worthwhile alternative that he may be able to order online. If it is against the rules to post product names please email info to him.

Salvia is illegal in Florida so it's cool that you're going to visit but it isn't going to help swiy.

No there is no alternative to Salvia. It is distinct. Swim has done many things almost in the world somewhat and there is no substitute for Salvia.
