Legality of Kratom in the USA

Can anyone help me understand why Kratom is sold as incense? It freaks me out to think about consuming a product sold as incense. According to the DEA there are 0 regulations on it, and the FDA website was no help either. Its on their poisonous plant list, but so is Kava Kava, and many other herbal dietary suppliments.

though Kratom is not currently illegal in the USA many vendors would like to keep it legal as it has been getting a lot of bad publicity of late. Thus they sell Kratom as NOT for human consumption and rather as a herbal incense.

It is also a good thing to keep Kratom off of the dea's radar as much as possible. swim knows of no widespread ER visits because of Kratom and its benefits are many.

as with all herbal medications swiy should do a lot of research to understand any possible effects of long term use. Even though K is a miracle plant in many ways, there are risks in overuse. There is still a great need for medical studies of this wonder plant.

the D.E.A has been aware of Kratom use for some time.
In July 2005, the D.E.A.'s Microgram newsletter included a section from the N.D.I.C.'s Narcotics Digest Weekly which was entitled "Herbal Drug Update: Kratom".
This article described Kratom as widely available through internet vendors and "head shops", although no evidence for this was cited. The article also includes a brief one paragraph summary of Kratom's effects and modes of use, then states: "N.D.I.C. has not yet received law enforcement reports regarding Kratom abuse in the United States."

The D.E.A. also added Mitragyna speciosa Kratom to their list of "Drugs and Chemicals of Concern." this list does not appear to indicate anything other than that the D.E.A. has noticed the existence and use of a substance, and has come to believe that Kratom use should be monitored or assessed for potential scheduling or not.
In the D.E.A.’s terms: ‘”The substances listed represent chemicals that are being considered for possible evaluation or scheduling under the Controlled Substances Act of 1970 (CSA) and its subsequent amendments”…

Thanks again Benga for your insight and knowledge.

Those who appreciate the benefits of Kratom hope that the law enforcement in the U.S. don't see any abuse stemming from the use of this wonderful plant.

This herbal medicine helps so many people who would otherwise be hooked on opiates to get the pain relief they need.

Does anyone know of the DEA ever actually stopping shipments of kratom?

The dea, no. However there has been a few instances of fed ex holding up shipments of kratom for a few extra days until it was analyzed and found to be legal. This was only in large quantity shipments though so I think there is no issues other than that.

If your selling somthing "for human consumption" and somone gets sick, your leaving yourself wide open for a law suit. Americans are trigger happy when it comes to sueing companies, so its wise to just sell as an incense and avoid the fuss.
