rolling papers wtf

okay so swim was driving home from work 3 days ago and got pulled over for running a yellow light. after the police officer got all of swim's info went back to his patrol car, and came back he asked if he could do a search of swim's car..swim asked why and the policeman said that he could smell marijuana coming from the inside of the car (which was bs because swim hadnt been smoking anything). After awhile swim gave in and said ok (only because swim knew he didnt have anything illegal). Well little did swim know that rolling papers were enough for a paraphilnalia charge...heres where it gets fucked up..Swim has been on probation for the past 6 years for distributing large amounts of marijuana, and was suppose to be completed in 2 months. Well this charge violated swim's probation and the policeman arrested him and swim had to sit in jail over night until he could get the 15 grand at which his bail was set at.

Swim is really worried at this point because if this stands in court swim could face a sentence up to 10 years in a state prison, and a minimum of 2 years for the violation.

swim doesnt understand how the police can get away with making up complete lies like this (smelling the MJ), or even the fact that ROLLING PAPERS which i had bought in a store can be a violation of swim's probation. its so unfair. the cop which did the arresting wouldnt even listen to swim's explanation.

any suggestions to what swim should do here would be greatly appreciated, thanks.
