In many states in the US (possibly all) it is illegal for the police to pull
over a driver just because they look too young to drive. If that driver
does something illegal and the police pull them over and then find
out that they are too young to drive then they get in more trouble,
but they have to do something like run a red light for that to
happen. ANYWAY....I was wondering if this law would apply to
drinking. If I were to drink in front of a cop in a totally legal manner
besides the fact that I am too young could they attempt to arrest
me? I think it relates to that whole specific facts thing, and looking
like you might be to young isn't really a specific fact.

you could be arrested for using a fake id to drink the alcohol. you could be arrested if you are doing something that warrents them asking for your id and finding that you are underage.

however in the most states it's completely legal for a child of just about any age to drink on their family property. since you're on this site, I expect that you are 18 or 19 or 20 to be underage. so if you are able to walk into a bar and order a drink and not get asked for id, then you should be fine drinking there. however if you are drinking in public, the cops will have a right to ask you for id, which could lead to your arrest.

if you are underage and must drink do it at home where it's legal.

I dont think it is "legal" to drink on your own property. What about the guy who got arrested for alowing his kid to have an After Prom Party last year and the dad got arrested? The dad did not provide 1 oz of booze to anyone at the party, but when it was known that underage drinking was going on there then the cops came and arrested the dad.


I think it is safer to drink on your own property because you have to do something for the cops to come to your house or they have to be tipped off in some way.
