New York border - Salvia seized 7 counts

I need some advise.... here is the story...

I have sent a few packages containing Salvia Extract that were seized by US customs in New York, 7 in total.

According to the carrier I used they required the receiver to provide them with social insurance number in order for the package be cleared by US customs. I found out that was bogus after a receiver informed that he called US customs who informed him they were holding the package for the foreseeable future and that they informed him that my company was having issues with US customs.

Since Salvia is legal to be sold for non-human consumption in Canada and was labelled as such for transportation, moreover it was also legal to be sent for such purposes to the 7 receivers who were all in States that had no laws against salvia being sold for non-human consumption purposes.

What are the repercussions, does anyone know? Am I going to be black listed for life and never allowed to travel to the US because of this?

Salvia is not authorize for resale purposes however the bill does not specify it does not authorize the transport of therefore to another state. Moreover as stated below the bill has not even been voted into effect...

D4P, my friend Lizard had problems personally bringing a small amount (15gr) Salvia Divinorum leaves into the US from Canada on his person.

A bunch of tests were run on it, none of which tested positive for anything. Ultimately (after 2 hrs. detainment) they had him assent to forfeiture of "15 grams of unknown green leafy substance." This was in 7/08.

I don't think you'd be in any legal trouble for the Salvia itself, but there may be some importation irregularities...I'd imagine US Customs has a dim view of Salvia and would be happy to cite you for any irregularities, no matter how "ticky-tack" they may be.

Would you be able to send replacement deliveries of Salvia? It might be good for a customer-relations perspective, if you plan to be selling Salvia for the forseeable future.

The easiest way to see if you'll be barred from travel to the US would be to attempt it?

SWIM believes that is exactly what he plans on doing sending more to Customers but within the US, he has shipper in the US now...SWIM has only really had such problems when sending by Carrier and strangely enough just within this past year. It started all on January 12, 2009. When first seizure occurred.

Regular POST there is no problem, SWIM believes that prior volume through carrier 9-10 packages may have triggered attention to this...there after on day of seizures, more sent and those were the ones confiscated. Carrier informed SWIM that packages will be returned to SWIM place of business because the receivers did not want to provide Social Insurance validation. Perhaps SWIM is just paranoid but hopes it is nothing. IF packages are returned then SWIM should be okay hopefully... SWIM also never puts name just company name on there...

SWIM noticed US custom require some new paper work for imports ... NAFTA documents are a must! If they are missing custom will automatically seize and hold package.

SWIM has not yet travelled to the US since that occurred but SWIM imagines that if preventative measures were in place it would take more than 7 packages and many months to carry weight on the enforcement of SWIM travel ban. Does anyone know how import irregularities work...how severe is the infraction? Will it result in prosecution... SWIM has been doing this for a long time and SWIM always properly declares it as Salvia Incense [Not for human consumption] and includes all relevant data.

SWIM experience with Custom is a bad one they are jerks and hate their lives and will not answer questions you ask them on why something happens, and will randomly decide to hold package for unknown reason even if said package is legal. It seems custom has abusive powers in the US.

.... Other experience once SWIM sent Salvia by Carrier to Russia and US customs seized it... kind of stupid since it wasn't going to the states but only transiting through it to Russia. When SWIM contacted Customs they said SWIM was trying to import hallucinogens when SWIM protested and claimed Salvia for research purposes and not human consumption as clearly stated on the declaration, and protested to seizure, officer talking to SWIM hung up on him...

SWIM has had worst experience with US customs, SWIM thinks for a country that raves about free trade it has some idiotic custom staff who follow no rules and make them up as they go along.... If SWIM can send to a post communist country some Salvia why can't he send to the US where it is also legal....

IF anyone else has experience or could aid SWIM in averting a heart attack please SWIM look's forward to suggestions and advise.
