Probation- Drug Testing: Bad News

Today SWIM's probation officer paid a "random visit" to SWIM's school for a swab-drug test.. Problem was,
SWIM before smoked weed and blew heroin for the first time in weeks the day before. SWIM also did a small line of coke an hour before the DT (coke being a long lost drug too.)

SWIM bought a home screening kit and came home. The urine screen showed negative for everything. SWIM is 18, weighs 123 lbs.

What will happen to SWIM?.. What do you think the probation swab test results came out as?
Has anybody else been in a similar position to SWIM's with probation?

There is a chance it may come up as negative just as the home test did. But home tests may be less reliable than professional tests.

But If it comes up positive, it will be a violation of probation and depending on the particular laws in the state SWIY lives in and also depending his your P.O. they will either come and arrest him and take him to jail where he will wait to go before a judge or he will be contacted by his probation officer and be notified of a court date that will determine further sentencing. Either way SWIY will most likely do a little jail time.

SWIM has failed a piss test before (only for THC) at a probation visit and they said that since it was only for THC, they did not have to arrest him on the spot. SWIM was to return to his probation officer the following month and he would be notified of his court date. His P.O. told him she was going to recommend he do 30 days in jail.
SO.... SWIM made the decision (a poor decision) that he would just not return to probation. The police caught up with him a few months later and he was arrested for violation of probation. His P.O. recommended he spend the rest of his probation time in jail. which he did. In the state SWIM lives in the county offers 2 for 1 on ones days so long as the crime is a misdemeanor which basically means one only serves half his time/sentence in jail. So SWIM had 9 months left on probation when he violated and he served 4 and half in jail.

Had he gone back to probation and went to court he would have only gotten a 30 day sentence and would have only spent 15 days in jail. SWIM's advice to SWIY is not to run.

Another thing to be noted is that when someone is arrested for violation of probation they do not have a bond.

As I said, SWIM hates to break it to you but this is the truth. Good luck to you and let this be a lesson.

Swim has passed a quest labs drug test about 12 hours after he last smoked... and he smoked a lot. Swim can offer no explanation except he drank a normal amount of water the day of the test. His was a urine test. Swabs supposedly have a shorter detection period for most things but are more sensitive. Good luck.

Isnt the point of probation to help rehabilitate you?.. wouldn't SWIM
be thrown into rehab? SWIM was 17 when convicted and sentenced to probation.

SWIM has a friend who was arrested on heroin possetion. Same P.O as SWIM- as far as SWIM knows (which is not much), SWIY is in rehab, but the P.O is not pressing charges.

I've read that swabs can detect recent use (or under the influence)- much like blood tests. (SWIM did a line of coke 1 hr before the test.)

SWIM did mention hes taking amoxicillan and flu medicine/sleeping aids (possible false positives for coke/heroin)

LOL ....Sorry SWIM was half asleep and started off his post in 2 different ways and forgot to fix it all the way when he switched. Its fixed now.

Expect the worst and hope for the best.

I can help out here, swim failed 3 drug tests for his p.o. all for pot which he was arrested for, so of course swim got punished. House arrest for the rest of his probation time is the only thing he's gotten because he's a minor. So depending on your age it could be the same. swims p.o. also told him after the first test he failed that courts usually let the first fail go and it also makes a difference if you tell them your going to fail the test or not.
