Caught with research chemical - serious legal trouble

this summer swim1 had a bad experience with 2ce that led a hospital visit and police involvment. they said they would not press charges but recently they arrested swim1 for possession and claimed that it was like 2cb and mdma (analog act perhaps). While at the jail, swim1 told the police that swim2 had given swim1 the 2ce. Now swim2 is worried that the police will arrest them as well. swim is wondering if anyone knows how to best handle this situation. swim1 is looking at some jail time. swim2 does not know what will happen to them but swim2 is hoping that they have nothing on them because a) swim2 gave swim1 the 2ce, did not sell it b) the bag was clearly labelled not for human consumption, research purposes only c) they have no proof of swim2's possession.

So if anyone knows what can be done or any type of legal information that can help swim1 and2 out that would be very helpful. it was less than 1 gram.

there is a simerla post on hear adzket wrote for swim i think legal troubles with rc's
utdfse it will help plus get legal advice from a spesalist in field there r some mentioned on hear look in law and order. also in most countrys even giving drugs, & not selling them for money or other goods, is classed as supply. so in thory swim 2 could be arrested and charged if there was evedance of them doing this but atm it is just swim1's word against swim2. which is nothing more than hearsay.

Search the law and order section of the forum in particular. There is a link to a lawyer who deals especially with RCs and he will give a free evaluation if SWIY sends him details.

This post should probably be moved to that section. If SWIY wants help in this forum (not that I can offer much, my legal knowledge is minuscule) SWIYwill need to give much more detail about the case, like what evidence they have, what charges have been laid, what SWIY has been told and what SWIY told them, etc.

Good luck to SWIY, keep the forum updated on this situation.

Stop talking to the police. Get a lawyer. That's it.

You're digging yourself a hole by talking to the police, don't you see that? Shut up and get a lawyer. Why you even bothered to talk to them in the first place is beyond me. Frankly this sounds like "scared straight" tactics, but don't push your luck.

SWIM almost graduated lawschool before getting addicted to heroin, and can tell you that most drug cases are prosecuted for "conspiracy," which is some bullshit that allows them to throw people in jail with less evidence.

You could be prosecuted, but usually the DA will weigh how strong the evidence is, how likely you are to get a lawyer (otherwise they will railroad your ass), and how much of a pain in the ass it will be. They usually like to give one person a deal to narc on the other, so swim2 might be in some trouble.

But I guess all of this is moot, since internet advice cannot substitute for the fact that you will probably need a lawyer.

Oh yeah, and NEVER TELL THE POLICE ANYTHING. It is basically NEVER in your interest to do so. Probably like 80% of convictions could be avoided if the people just shut their mouth and didn't let the police intimidate them.

^^ good advice. Keep your mouth shut, clean house. Also it would not hurt to be able to pass a drug test. Your case is different because the substance is "legal". The person who ate it broke the law. but with out hard proof one users word against another does not hold up well in court without tangible evidence. The right to remain silent is one of the best. Also do not trust people on the internet with legal advice, talk to a lawyer.

Swiy1 should take a dirt nap. That is seriously fucked up, the is no excuse for it.

Swiy2 should wise up, and not distribute to spineless scum like swiy1. Also swiy2 should definantly not bring swiy3 into this, even if swiy3 is an online vendor.

Swiy2 should get a lawyer (If broke, get to know your public defender, if he sucks get a different one, good public defenders do exist). Swiy2 should also read up on the analogue act and any applicable state laws.
