It depends on where SWIyour friend was caught. If he was in the USA he could get in pretty bad trouble. It is a schedule I substance here.

Also, the amount tiers for punishment are pretty wack. 11 pills is actually a pretty large amount to be caught with believe it or not.

The amount of trouble he will get into probably depends on what drugs are in the 'pills'.

If they were just aspirins, he'll probably get off scot-free. If these 'pills' are a controlled substance however...

edit: I don't mean to bust balls or anything, but you should try to use a drugs proper name (in this case MDMA), especially in the tread title.

I just assumed it was ecstasy. hehe.

Jail time is a possibility, but I am pretty sure ecstasy is a lot more common in the UK(especially London). I wouldn't be surprised if you got off with a large fine and court costs. Keep us updated!

If a first offence, then your unlucky iguana would be very unlucky to serve a custodial (prison) sentence,although it is a possibility, Ecstacy (MDMA) being a Class A drug, & the contents of many snide pills being Class B at least. If the dealer were in fact a dealer, & not just a set-up, then they will be in a lot more trouble than the buyer. That said the buyer needs to be damn careful what he says from this point onwards.

Talking to a solicitor asap is the best & only advice that can be given here.

The very first thing to do is not to talk to the police until SWIY has spoken with a solicitor as MM has said.

Assuming the "xtc" pills contain MDMA, then they are a Class A drug. The most likely charge is possession of a class A drug (Misuse of Drugs Act 1971, Section 5).

Class A possession is an either-way offence, so it can be tried in either a magistrates court or a crown court. Possession is very rarely tried in crown court, so I'll concentrate on magistrates court.

The entry level for 1st time offence pleading not guilty is a community penalty. Mitigating circumstances can bring this down to a fine; aggravating ones can bring it up to custody. Based on what you have said, I think that custody is unlikely.

If there is essentially no viable defence, then pleading guilty will give a sentence discount of up to a third.

Must be nice to live in the Uk..in swidj place..11 beans..will charge 1 with intent delivery of a controlled substance..with a maximum prison sentence of up to 20 years..of course that all depends on 1's past history and other factors..swidj had a friend who's first offence was 5000 hits of lsd..they gave him a mandatory minimum of 10 years and..he did 4 in federal prison..and 6 in a federal rehabilitation centre..he was extremely lucky..cause here they consider 1 dose..attempted manslaughter..regardless, if 1 gets caught with 11 pills here..expect at least jail time..if not prison-good luck..hope it all works out for swim-DJ

Yea obama will change that soon.
In a recent speech he pointed out that selling like 8 ecstasy pills will warrant the same class felony as raping a woman at knifepoint.

EDIT: Here is the exact quote from his website, "In 2001, Obama questioned the harsh penalties for drug dealing, noting that selling 15 tablets of Ecstasy was the same class of felony as raping a woman at knifepoint."

That's assuming they are MDMA - most of the shit floating around london at the moment isn't - and on that basis, there would unlikely be a charge to the buyer though the dealer....that could get complicated!

If american law stands like that, it's ludicrous. 11 pills is half what one or two people SWIM knows take in a night. SWIM has done plenty of pills and been raped and SWIM would happily talk to any law makers about the considerable difference between the two.

If you get arrested you will be charged for the possession of a schedule I substance.
If you have enough then you will be charged for having a schedule I substance and supply.

If anything you will probably get more time than someone who actually did commit man slaughter, even though you will not get charged for that.

If SWIY's friend has never been in any trouble whatsoever with the police, it is likely he will receive a formal caution (slap on the wrist).

If SWIY's friend has been in trouble before and is charged with POSSESSION of a class A drug, it is likely he will recieve a conditional discharge or a small fine. If SWIY's friend has a long criminal record, he may end up with some unpaid work or possibly a supervision order.

Unless of course the pills are actually MDMA and not some crappy piperazine. Then he may be OK.

SWIM's little brother got a 5 year prison sentence for dealing about 80 pills. He did about 2 years of it in actual prison.

Glad to know our countries are equally ridiculous about it.

The drugs laws in the UK are far more liberal than in the US. Getting caught with 11 pills is simply a matter of possesion and, assuming SWIY has been in no trouble before he/she is looking at a police caution at the very most.

If SWIY has a lengthy criminal record and has been out of trouble for some time, a community order or small fine would be most appropriate.

Plus the States have mandatory minimum sentances, which the UK does not.
