I was wondering, can you be charged with anything for having different
drugs in your system when being tested for something else? A friend of mine was picked up last night for possession of marijuana with intent to distribute. He was driving while he was stoned, officer noticed, searched the car and found it. He was taken downtown, drug tested, and then put into a holding cell. He's currently awaiting bail and myself and some friends will be picking him up either today or tomorrow so we haven't been able to talk to him. Anyways, when they drug tested him to get proof that he was under the influence of marijuana, can they get him for anything else as well? He would have tested positive for cocaine, amphetamines, and opiates. I was wondering if he could be charged with any of that because they didn't find any of that stuff on him and he wasn't under the influence of any of those at the time. There isn't any way to prove that he wasn't under the influence at the time though. The cops may see the drug test and just as easily say that he was on all of those at the same time. So since they didn't catch him with anything besides marijuana, can he be charged with anything else? Thanks in advance |

It depends on if your state has a wacky internal possesion law or not,
but in all honesty no you're charged with what can be found. |

im kinda curious about this question too. if they cant prove he wasnt on it at the time would it make shit worse for him? like say someone was driving under the influence of pot and alcohol, would that be a worse DUI than just pot?

Like unico said I believe it is up to individual states (in the US) to
decide exactly how to deal with intoxication. Regardless if you fail a sobriety test I believe you can be charged with DUI even if they don't detect alcohol. |

Correct me if im wrong.
Should they piss test him for weed they will find traces of weed in the piss. But the piss test will probably not show that he has been using opiates aswell. I thought u had to look for something in the piss to find it. P!MPJU!C3 |
