Arrested for having opiates in system

This is in the UK by the way. A fiend of mine recently had his flat searched by a policeman as someone they thought to be a dealer had been in his house. Now there were no drugs in the property however there was a syringe and a pan with a cotton out on the side. Now the police officer said to my friend after he found no drugs. 'You haven't got any cannabis that I can arrest ou for have you' When my friend said no the officer got agitated and picked up the pin and said you do know that in the UK you can get done for possession if you have just used!? Well my friend has been dealt with and given a caution for this.

My question is this:

Is this actually legal what this officer did?
I am pretty sure that they cannot do you for possession if you have already used the substance.

It all seems pretty unfair and seems like he go a caution because the officer was pissed that they never got the dealer.

Any info would be appreciated as my friend would like to appeal if he can

I thought it was only Dubai and a few other nutty religious far flung places that they class drugs in your system as being 'possession'.

I'm not sure about in the UK but if the cotton had already been used, there could still be heroin residue in it and in the USA, they can charge you with possession for that

Sounds extremely dubious, i suggest consulting a lawyer and challenge the caution. My fiend has been caught by the police on two separate occasions after injecting with spoon and tool in hand, they can't do a thing, that said, in Scotland they don't caution you, it's arrest or release.

SWIM thought it seemed highly dubious. SWIM was positive that having drug paraphernalia is not illegal in the UK

here in the states, if you admit to being high on a substance they will bring you in and give you a blood test to confirm it then they can charge you

I've been told that if the old bill catch you in the middle of having a hit they have to let you finish what you are doing and deal with you when you're done with your dig.
On a seperate note, one of my closest pals was strolling down the street one day, a dealer who he knew walked past him and they said hello to each other, next thing he knew 200metres down the road, undercover plain clothed DS jumped on him, marched him to van and then the station followed by a strip search - spread your cheeks, pull your foreskin back the lot!! Screwin'!! 'Association' is what they wrote on the slip.
Glad it wasn't swim who had to show his tinky winky to the feds lol.

I have never heard the thing about finishing a hit but it does sound reasonable, the police don't want to be going near anyone with an uncapped needle. I still think if the plunger hadn't been pushed they would order them to take it out and cap it, if the person just went ahead and pushed the plunger i imagine they would be none to pleased about it, even if they can't do anything (but they might "find" something).

SWIM's friend was actually arrested for "internal possesion" of heroin about four months ago. He had a little bit over a gram "in his system".

this is bullshit, or should swim say a bloody disgrace. First off swia could have said it wasn't swia's pin and cotton and even if they did find opiates in swia's system swia could have taken over the counter painkillers. Unless they actually tested for H and H alone, which would surely mean sending the sample off to a lab at great (tax-payers) expense.

What a total joke, the copper was obviously so annoyed they didn't find any drugs on swia they thought they'd get swia on a technicality and hope swia confess to other shit.

Eh,SWIM doesn't know for sure that it really happened.. But the dude was arrested on a probation violation and he had been doing quite a few balloons a day and SWIM was told by a close friend that he had been arrested for internal possession. SWIM has no reason to make this up.

Do they have any evidence? Best thing to do is to consult a lawyer and find out where they stand. I really don't know anything about cautions, is it something you have to let the police do, or if you disagree with it, do they arrest you instead? I imagine they would threaten you with arrest if you refused the caution, that way they probably get away with cautioning people most of the time.

A caution is something that stays on SWIY record and is classed as a conviction I think. SWIM thinks it is wiped after 5 years though

I knew it was kept on record and that is why i think it should be challenged. According to Wikipedia a police caution is not the same as a criminal conviction but it does result in someone having a criminal record, if this is a problem, i would challenge it.

SWIMS had cops in his house when theres been used works on the kitchen side(SWIM just had a hit) and they just took care not to go near them. They looked concerned as they were in the house for an altogther different reason. They never enquired about drugs although when they left SWIM thought he should tell show them a box of his legal amps and say that what the works were for just in case they labelled SWIMs house one of ill repute.

SWIM was searched once when pretty high on H but they let SWIM go after taking us down the stattion for a search claiming they has seen SWIUS buy drugs(which they could well have) with his friend who managed to somehow half swallow the stash in his throat and SWIUS enjoyed it very much later on and appreciated the fact the Police bought us very near SWIMs house saving SWIUS a long walk from the other location after spending all monies on gear.

SWIM has never personally experienced shit like this but has heard stories. The Police can sure make your day bad if they choose to which is why SWIM is always polite, friendly and helpfull but 'firm' with them and believes this has saved SWIM a good few troubles when SWIM has transgressed certain traffic laws or when arrested SWIM has been treated ok(as can be expected) SWIM's has seen friends who have been lippy and resist and the cops will make sure they let them who is running the show.

I would get advice on this as I have never heard of anything like this. Maybe the cop was having a bad day made worse by not getting a result on the search. Some cops SWIM has come across just HATE drugs and drug users with a passion and no matter what your in for a tough time.... this could of been one also.

Maybe SWIYmother

Funny thing is the same officer pulled SWIM a few months back over a charity box that got stole and he seemed a perfectly nice guy. He said to me I know your a good lad and wouldn't do it so it really has mystified this SWIMMER. They had SWIM on camera walking away from the scene apparently but not actually committing the crime.

This is quite despicable now SWIM thinks about it with a clear head.

Maybe he didn't know SWIM was a user

Swim found out last night that swims dealer has been nicked. This is very bad news for swim as swiswimsdealer is about the 5th one to go down. Swim doesn't have anymore contacts in swims area (that swim can trust) and this will mean a drought for sure as all the other dealers will go to ground as doors are going in left,right and centre.

swim knows this is a bit off-topic but, swim wanted to get swims point across without starting a fresh thread

Over 10 years ago, in the States, SWIM's girlfriend was stopped by police for a minor traffic infraction. On approaching the car, officer saw the girl swallow the evidence, a 'roach', the butt of a marijuana cigarrette. Smelling the telltale smoke, but not having any other evidence, the frustrated officer arrested her for DUI (driving under the influence), taking her to hospital to draw blood. Test confirmed. Convicted.

That's way underhand. Cops are pricks aren't they? Thing is if the are testing for cannabis it stays in your system for weeks on end doesn't it?

That seem a little unfair to this SWIMMER
