Are Fresh Liberty Caps Exempt From Class A Regulation (UK)?
SWIM had a very successful picking with friends of some Liberty caps in Sefton Park at 9am this morning and was looking up more info on them out of curiousity.
SWIM found this site: http://www.thegooddrugsguide.com/mushrooms/faq.htm#04 Which states that Liberty caps are legal (unclassified?) in the UK because they grow freely. SWIM's aware the drug laws in the UK changed in 2005 to include fresh mushrooms but do they hold true for the common cap? SWIM is currently drying out the hoard, for good use this weekend ![]()

True if SWIM is taking them this weekend SWIM should refidgerate them instead!
SWIM wants to store some anyway so will dry some. |

Hmm, thegooddrugsguide is not it seems a good information guide, as that link is very misleading. it is legal to have psilocin & psilocybe containing mushrooms growing on ones land. It is legal to pick them in order to have them destroyed by an allowed party (i.e. the polis or the British Mycological Society). It is not legal to pick them for any other purpose, although there are some potential loopholes that so far as I am aware have not been tested in a Court of Law (I know, I stated otherwise elsewhere! Sorry!). Yet...

The uk law was changed to making any fungi containing psilocybin pscyobin to be a class a drug fresh or dry.

Indeed. But with the exemptions described by the mouse. And since these exemptions turn the whole law into a Swiss cheese of loop holes, there should be plenty of room to manoeuvre.
If someone would be caught with a bag full of freshly picked mushrooms and the person would claim to be on his/her way to the nearest police station to have them destroyed, then there would be no case against the person. (assuming that there would be a police station in the direction the person is travelling in) There probably are a lot of scenario that would allow for legally running around with shrooms. |

From the Home Office, what is interesting though is the get out clause of having no knowledge of possession of an illegal fungi.
