Snorting YOUR prescribed medications
SWIM was wanted for a friend in the parking lot outside there work. SWIM had 10 or so minutes to kill and decided to snort a couple 80mg oxy while he was waiting. Now SWIM has a LEGIMATE PRESCRITION for 80mg OXycontin, the bottle with all the proper labels as it comes from the pharmacy was also in the car. SWIM crushed up the pilss and snorted half right has he finished there was a knock on the window 2 Sherriffs were right there. SWIM opened the car door (SWIM did not have the keys in the ignition) the sherriff took him out of the car, said "I saw you snorting something" and cuffed him. They grabbed the cd that had the oxy on it and put it on the hood of his car. SWIM explained that we was snorting prescription mediction in which he had a legal prescription for and told them were it was so they caoulf look at it. They asked SWIM why he was snorting his medication and he told them that he was in alot of pain and needed immedate relief, he They also left the cd with a big rail of ocy on the car. SWIM called the police station already and inquired about picking up his meds being as he neede them and they could not make the decesion they were not needed, being as thye do not ahve medical lincence. They said thye would call swim back..which swim dont think they are.
SWIM thinks he should call a lawyer since they took his meds..SWIM thinks there is a lawsuit there that SWIM can win..SWIM might have to go to emeergeny room if needed, and swim knows that would be better for lawsuit. SWIm is going to call the station tommorow if no call tonight to get his meds back...what should swim do?? call a lawyer??? SWIM is going to get a new rx tommorow being has his doc is open onm sunday if needed but would rather have his back since there is about 65 80mg oc in the bottle. any advice? oathrocks added 5 Minutes and 29 Seconds later... urghh half my post is erased and I cant edit they post!!! The sherriffs took swims meds and let him go, that is the just of it. They said that he was abusing his medication and they confisacted it. SWIM told them they could not take my medicaiton prescribed form his doctor, they did not have a medical lincese and were not qualified to make that decesion. they laughed at swim..swim called the station and asked for his meds they said they would call back with an answer, they have not called bakc and swim is giving them to 10am before he calls again Last edited by oathrocks; 14-09-2008 at 10:09. Talk to an attorney. The cops will probably claim that SWIM was using the medication in a manner not consistent with the prescription - if they saw (or lie) SWIM snorting them. First stop - attorney. Explain the situation to the doctor if possible. See what the doctor thinks.

Swim's friend is on hydrocodone/apap for an old injury blah blah blah. The doctor told Swim's friend, and Swim's paraphrasing as he wasn't actually there, "Here's a script for some pain pills. Takes about 1/2 or so to kick in. If you're in a lot of pain, break it in half. If you're in INTENSE pain, chew it." -- But as Panther007 points out, that's still when the pill is intended for oral use.
There's also the argument similar to the above, that snorting the pill would have been an "off label" use, but still for pain relief. Really, there's an *intended* route of administration, but ultimately Swim does not think Swiy has technically broken any law. Than again, Swim's no lawyer and agrees that it might be a good idea. For kicks, however, you could keep calling the police station, or even go down there, and demand to see the civic code Swiy was in violation of. Might even be able to get 'em back. Unless the cops are crooked (gasp!), they should be either in the police station or your county lock-up center or something. But again, lawyer would be a good stop. Swim personally would be hesitant to talk to his doctor unless they had a tight bond. Some docors would label you addict and put you on NSAIDS. |

I feel your pain brother. Sometimes though it is just alot easier to take the low road, maby speak to your doctor and explain that the cops took your perscription and see if you can get a refill. If I was in your situation, I would make sure you don't forget to stop hassleing (sp) the police.

Yes lay low man... This was a terrible situation to be in.. But it could result in a lot more if you call the cops a lot.. They remember and they might just give a call to your dr. And then the dr afraid of losing his practice might just cut you off all together.

SWIM got a call this morning and was told he could come to the station to get his meds, and was a little leary he could be arrested..for some bullshit. SWIM went down and a dective wanted to ask him some questions he decied to talk to him..After a couple questions SWIM was given bakc his medication and was told that he did not go anything illiigal persay, since they were legally rxd to him and there is not law agaisnt snorting, shooting (not in public) medication. The dective said that they had contacted his docter and informed the doc what had happened. LOL>.SWIM called the seceratry at his doc office this morning and let here know was happened in case of call, sinc they are very good friends...she called him later to say they called and she delt with it, so the doc does not know..but swims doc is very.

SWIMS doctor is every lets say "liberal" to say the least if the police did contact her and tell her what had happened SWIM would not have been cut off from his meds..SWIM does to the doc every 5-7 days and gets a month script each visit. His scripts alone will be enough to get her charged if and for sure when she gets investagated, hell everytime SWIM goes he expects to see a padlock on her office door...
SWIM spoke with his doc and asked if it was iliegal to chew-snort-shoot you medication, being he was curoius. The doc said that technically speaking it is not, unless you are shooting in public, then they could charge you with something if they choose.and they would let the docter know. SWIM also asked a lawyer about this and he said there was not law stating that you could not do so. The only thing that a cop could try if he wanted to be a dick and arrest you for somehting if you were snorting-shooting would be public intoxication which my lawyer said the chances are the DA would drop charges.if dirving he said that DWI would be the officers choice.. Overall SWIM had a very interested experince, and he was very happy he got his meds back! being as 65 - 80mg oxycontin are not cheap, so all and all it worked out....medication back and no charges to deal with! anyone ever had anything like this happen to them??? ( POLICE OFFICER YOU WANT TO WEIGHT IN HERE??? ) |

That's interesting. I was under the impression that using medication in methods other than described by the prescription would break some sort of law. Thanks for posting this story!

Get an empty bottle of Windex (a blue-colored window-cleaner). Wash it out carefully. Fill it half-way with water. Add a few drops of blue food-coloring. And park the car where that cop hangs out again. Start squirting the "Windex" into Swim's mouth.

You must be in a lot of pain. 80mg oxy's. What is it cancer? Swim would hate your withdrawal. Why snort, they are so strong anyhow?

I had a friend of a friend that was in jail but had a prescription for Lortab. His doctor seen to it that he was allowed to take his meds while locked up. For the first few days, he recieved his medicine as he was supposed to but on day 3 they just "vanished". His doctor and his pharmacy called the jail but the medicine never turned up and he had to go without for the remainder of his stay. |

If Swim's not mistaken, the not-using-drugs-in-public only applies specifically to shooting as there was a big stink about needles in the area. Not sure if it is local or federal, so if Swiy's checked with a lawyer and you've been advised by counsel that it was not illegal, you've probably got a case against the lawyer. In that circumstance, a judge would likely be obliged to throw out any charges on you, excepting perhaps public intoxication.

That one has a prescription for the medication that he is snorting has no bearing on the legality of ingesting that medication in a manner not consistent with its labeling. If your prescription bottle tells you to take 1 tablet by mouth 3 times daily, for example, you cannot opt to crush up the tablets and snort them, inject them, or ingest them rectally (though it would be difficult imagining a situation where you would get caught doing the latter). The same is true for misuse of seemingly innocuous products (inhalants, i.e. "huffing" spray paint, comes to mind).

when not taken as directed it's punishable under law. This is why it's illegal to take a pill that isn't perscribed. It's not as directed.

i do not think that there is any thing wrong with what swim does maybe it releives his pain quicker and its his body and he also has a script for them
so the police should have looked at the bottle and seen his name on it and not jumped the gun so quickly thinking that it was coke or some thing like that best regards the vez |

1. check the rules on incrimination 2. common sense and right and wrong do not necessarily have any bearing on the law. And if we're applying common sense, were SWIM a cop who'd just seen somebody snort a line and had them claim it was their meds, he'd assume they were using coke and lying about it. Considering swiy did this in his car in public, I'm very surprised they didn't attempt to charge DWI. I guess swiy was saved since swiy didn't have the car on.
