False positive saliva cocaine test results in 104 day incarceration without bail
My sister who is 50 years old, is in jail, and I am extremely frustrated. She tested positive for cocaine twice with saliva tests, and is being held Without Bail on an original $5000.00 bail, in Steuben County, Indiana. Cocaine and Marijuana possession charges (trace amounts) were dismissed, as the situation involved kids (17 - 22) in her house who were holding - no one could prove what belonged to whom. The charge? Public Nuisance. We can't afford an attorney, and the public defender (Anthony Kraus) has not ordered another test while she is in jail to see if it comes up positive. He also didn't order another blood or urine test, and didn't appeal the judge's decision.
She has a hearing on Sept. 15, 2008. I thought violent murderers with witnesses were the people held without bail, not people charged with "public nuisance". Does this sentence seem to be too severe to fit the "crime"? Any thoughts, help, legal referrals, would be greatly appreciated. Thank you all. |
