Question Legal status (UK) of various Tryptamines

Hello all, first post so please be kind (or brutal, as is needed).
I have been trying to find out (rather unsuccessfully) the legality of various tryptamines specifically calcium bufotenate.
In the UK (and UN) most Tryptamines are covered by 'catch-all' clauses in the Misuse of Drugs Act
Quote:
1971, Schedule 2 part 1 (b) - as amended from time to time.
Quote:
"(b) any compound...structurally derived from tryptamine or from a ring-hydroxy tryptamine by substitution at the nitrogen atom of the sidechain with one or more alkyl substituents but with no other substituent."

Also clever rewording (unusual for the government I know!) has pretty much systematically included most (if not all) tryptamines as discussed in TiHKAL, but calcium bufotenate is not mentioned in TiHKAL.



So two points here, the first more to do with the above schedule statement than the second but both relevant.


1) Does this include Calcium Bufotenate as being a compound structurally derived from tryptamine, and thus illegal. And would this include the preparation of Cebil (or Yopo) as being from a Bufotenin(e)/DMT containing plant (legal), dried and ground (illegal preparation<?>), mixed with calcium oxide and water to convert any Bufotenin(e) into Calcium Bufotenate (legallity??).
Thus is Cebil/Yopo legal or illegal or at what point is it illegal. My friends interperetation of the law is: Legal to own the plant, illegal to dry and grind (since it is a prep of bufotenin(e)) legal to own Cebil/Yopo since it does not contain bufotenin(e) but calcium bufotenate (ignoring the fact it contains minute amounts of DMT/5-MeO-DMT )



2) Now Bufotenin(e) has been listed as a schedule 1 (Class A I presume?) compound in the UK (UN too I think) but the Home Office themselves state that Amanita Muscaria - "Fly Agaric" and relatives (Pantherina, Gemmata etc.) have no criminal status and as such are completely legal.

As far as I have been able to ascertain, Bufotenin(e) can be found in A.Muscaria, so, surely this is quite a contradiction in the law, especially as dried preparations of A.Muscaria can be purchased quite (apparently) legally. But, Wouldn`t this be classed as a dried preparation of bufotenin(e) and thus illegal - just as DMT containing plants are not illegal until dried into a preparation etc.


Any one in the know??

Plants which contain controlled substances are legal in the UK.

Preparations of such plants are also legal, but there is a high risk of prosecution with such preparations. Previous court cases have set precedent that the INCB stance on this is correct: No plants are currently controlled under the MDA unless they are specifically listed. Only preparations of substances specifically listed as by the MDA are illegal. Still this is open to debate, so as stated before there is a risk of prosecution.
