If a cop was to catch me on Salvia divinorum ...

I am planning to smoke Salvia on the next full moon night on a weekend.
I am going to bring my water-pipe bubbler, and my 1 gram vial of salvia
10x extract with me to the local park at night alone. Say if a cop
caught me tripping out with sally D at the park in the field, could he
do anything about it? The reason I want to smoke outoors and NOT inside
my house is because

1. I have an EXTREMLY paranoid case with setting the house on fire.
This was evident during my first trip of salvia, I kept thinking after
I smoked the salvia, if I left the torch lighter on. Next thing you
know, I physically see fire everywhere in my room (it was all in my
mind) but I got scared and thought I was gonna die.

2. I feel WAY more comfortable if I were to be in a vast field, laying
down staring at the millions of stars and full moon with sally and
being with nature herself.

Salvia is legal as far as I know...but about the water-pipe? I bought
the water-pipe as a "Tobacco pipe" so could that be a loop-hole for
having the pipe with me? I could bring some rolling tobacco with me, as
an excuse that I have the waterpipe to smoke tobacco?

There are a few things to take into account here. First are
waterpipes/bongs legal in your state/county? If not than yes you'll get
in trouble for that. Second you will get in trouble for being
intoxicated while in public, I don't know how the salvia would effect
this cause salvia is technically legal, but only as incense. If your
gonna do it outside, find a place out in the country or a friends back
yard or something similar, nothing where a cop could stroll by and see
you. If you are underage you might also want to look into whether your
town/city has a curfew...I have been stopped a million times by cops on
this alone and I am over 18.

If your smoking device has any hint of marijuana resin in it, you can be charged with possession in most states..All?


You don't want to have to deal with a cop/narc while on a salvia blast. That probably wouldn't be very good.


So, how do you avoid all this? Simple, have a 'sitter,' and continue your experimentation in a safe, comfortable place.


In your post you state that you were 'EXTREMELY paranoid' about setting the house afire during a previous salvia trip, how do you think having to deal with law enforcement under salvia's spell would affect you? Zoinks!


Lastly, you should respect yourself, the plant, and other salvia users. If something odd happened to you under salvia..say you were found in an 'unresponsive state,' or something similar, law enforcement and the mindless media..In cooperation with the DEA would have another reason to possibly schedule salvia.


The U.S. DEA has placed salvia on its 'Drugs and Chemicals of Concern' list. This is a step toward scheduling. None of us want that. No need to give them any help in terrifying the masses.

Also in the US it does not matter if a chemical is legal or not for it to be public intoxication. If you are noticably intoxicated no matter the substance you can get a public intoxication charge. Same with DUI's of course, a friend of mine recently got a DUI for driving under DXM. He told the police what he was on and they had NO CLUE what it was.
