Hypothetical ex-dealer on probation situation
This is all, of course, hypothetical.
Let's say that SWIM lives in Texas. SWIM was just released from prison on probation for dealing. SWIM is staying clean, but has several enemies that would like to see him return to prison. SWIM is worried that they may try to plant drugs on him and report it to the police. They know what his vehicle looks like and where he lives.
If drugs are planted somewhere outside of SWIM's house, is that enough to convict him or would it need to be in his room, pockets, or vehicle? If an anonymous report is made, will the police take the time to investigate it and would it be enough for a search warrant?
SWIM would not have fingerprints on the paraphnellia, but considering he is on probation, would it matter?
