Legal to order spores to CA?

I heard that it was not legal to order spore syringes for P. Cubensis in California. Is there truth to this? If so, what sort of penalties would be imposed?


Any help would be much appreciated.

Its illegal in California (Georgia, Utah and Idaho also if I am not mistaken)</font>, but this doens't mean that you couldn't get away with ordering some.

I have no clue, but someone I knew in cali said that it was a joke
cause people ordered them all the time. If you do it don't use a credit
card, use cash instead or a money order. You could have it mailed to
someone you knew in another state and they cold then mail it to you,
that might be a better way of getting around the law if the company
that you order from refuses to send them to california.

There are three interesting
things about the California law regarding spores.

1. The law appears to state that it is only illegal to import spores into the
   state if there is intent to cultivate them into mushrooms.
2. It is not specifically illegal to possess spores, it is only illegal
   to "transport, import into the state, sell, furnish, or give away" spores or
   mycelium. Technically, this means that possession of spores obtained from
   mushrooms inside the state, which are not bought or sold, are not illegal.
3. Only viable spores appear to be illegal as the law specifically states that
   it is "spores or mycelium capable of producing mushrooms" which are illegal.

spores or mycelium capable of producing mushrooms or other material which
contains such a controlled substance shall be punished by imprisonment in the
county jail for a period of not more than one year or in the state
prison.



11391. Except as otherwise authorized by law, every person
who transports, imports into this state, sells, furnishes, gives away, or offers
to transport, import into this state, sell, furnish, or give away any spores or
mycelium capable of producing mushrooms or other material which contain a
controlled substance specified in paragraph (18) or (19) of subdivision (d) of
Section 11054 for the purpose of facilitating a violation of Section 11390 shall
be punished by imprisonment in the county jail for a period of not more than one
year or in the state prison.



11392. Spores or mycelium capable of
producing mushrooms or other material which contains psilocyn or psyoclyin may
be lawfuly obtained and used for bona fide research, instruction, or analysis,
if not in violation of federal law, and if the research, instruction, or
analysis is approved by the Research Advisory Panel established pursuant to
Sections 11480 and 11481.

mail them to cali the spore provider will most likely keep your money
and not send the spores.



What you should do is "3 way" it, you contact your friend in a
different state where its legal to send the spores, and have your buddy
recieve the spores and mail them directly to you.

According to erowid, it's only illegal to buy or possess spores in California and Georgia. Do you know from a reliable source if it is illegal to order spores to Idaho?

Yeah, spores are illegal in Idaho as well as California, Utah, and Georgia.
Almost all spore vendors will refuse to ship there.

However, in Mexico spores are legal by international law...

Would I have to order them to a residence in Mexico or, would there likely be some kind of shop I could buy them from. Well, I probably wouldn't trust buying them from a shop anyway, itcould have been sitting around for a year collectig dust until I buy it. Besides, if I went to Mexico, I would likely spend all my money on k.
