Question on Leavng the state on Probation
Swim got busted about a half a year ago on 2 misdemeanor drug possession charges, 1 felony drug possession charge, and several other misdemeanor charges (unrelated to drugs).
Now it has been a very long process for swim to wait for the court system to get moving on his case. The court system seems to be moving at a snail's pace. Swim was supposed to have court today, but even that got pushed back further. Swim doesn't intend to let these charges control his life or limit him from getting an education. In approximately 60 days he plans to attend college in a different state (only 1 state away from where he committed the crimes). Swim has already registered, found financial aid, visited the college and is all set to go. What swim is wondering is, can probation be enforced in another state or will swim be forced to remain in the original state and therefore not go to college? Swim realizes he will have to leave college and travel to the other state when court dates are assigned, however he is hoping to stay in college and not have to move back to the original state. Thanks for any help. In case it would help the state swim currently lives in is WI and he plans to attend college in MN. |

Yes your probation can be transferred to another state. It will have to be approved by your probation office I believe and the one you will be transferring to. You will most likely get it approved since it will be for school.

A comment regarding your case; It soundz to me as if you are getting frustrated with the case taking so long, maybe your considering "taking a deal" to get it over with...Take it from SWIM who has been there....DON'T! Don't agree to a felony conviction (with a suspended sentence or otherwise) just because you wanna "get on with your life", or for matter, any other reason either EXCEPT in the case that YOU, your attorney, AND another criminal defense attorney, are ALL sure that you can not get any better deal, based on your specific set of facts in your case. A Felony will fuck-up your future in many, many ways AND also and case which is not being vigorously prosecuted is a good sign that the DA's case against you is not very strong, which is a good thing!
With regard to those sayin' "get the opinion of a SECOND lawyer, shit I could even afford to get a FIRST attorney, which is why I got this Public Defender..." Here's a little secret on getting that opinion for free (if you are out on bail); just go to an attorney listed by your local bar and ask him/her to quote you a price for "taking over" you defense, The higher the price, the deeper the shit that you be in. Don't ever take a plea agreement unless advised by your lawyer. I had a couple cases a few years back that took around two years to finally be sentenced. Let your lawyer inform the court that you have plans of attending college. This does two things, one the judge will see that you are actually trying to do something positive with your life and may cut some slack. Second you may not have to show up until your sentencing date since they know you will be out of state. Its always good to let them know about the positive things you are doing. Show them that you aren't a lost cause that will be back in court a couple months later on another charge.
