USA - breath test vs. blood test ( alcohol)

Today I went to court for D.u. i. ( driving while intoxicated ) . they mean intoxicated by alcohol.

I was arrested returning home from a long journey. I was some 60 miles close to home when I was checked by a U.S. border patrol / customs road block.

They were curiously suspicous due to me driving a haul truck. wow.
these guys are looking for illegal people and dope.

I am neither, well maybe dopey. NIK had a good buzz going , but more strung out from the road than anything.

when they couldnt find drugs or weapons on me or the truck they went to plan B.

arrrested and turned over to the state highway patrol or CHP (california highway patrol).

this is just the begining of the journey. I get the tour , since the chp office was 60 miles in the other direction.

We arrive at the troopers shop, they have me handcuffed of course but ssoo fuckin tight, and the seatbelt was pinning me to the rear seat, I was in so much pain and could have blacked out from the seat belt .

these guys are just acting like jerks, and they found popcorn or something foreign in my truck , so now they cut into smaller pieces , and test for coke, then meth, then opiates, and of course it was nothing.

now they are asking for breathe test from me, okay I am cool with that, I have to be , cant refuse , its the law.

But I know NIK must have sobered up by now, he blows into the hose as directed. They look at the results but wont show me.
Then they want a second test, so again into the hose. NIK asks them what was the result, he said a number and that is a little over the limit.

Then I think of a plan, " I want a blood test " I tell them, knowing that it would take a drive to get to hospital for a nurse to pull blood, and Nik would have extra chance to metabolis (sp) any alcohol that may have been in his system.

That was a good plan and they drove me to get blood test. My hands at this point were swollen large and numb. I was still wearing braclets, and they were tight. I asked serveral times for a lil adjustment, they acted like they did adjust them only to put them back on the same.

anyway jail was next on the tour.

Today was court so a good friend rented a nice Nissian Z350 and drove me way the fuck back to where this town is.

I go inside to find my name on the docket and no beentheredonethat's name.
Then I go to window and ask them , no we dont have a case on you.

Call this phone number they said, that place then tells me the same thing , No case today , but try calling back every couple of weeks! what the fuck!

I am on one hand quite happy and pissed a lil on the other.

Bottom line time worked in my favor on this one. By the time they did the blood test on NIK at the hospital , he wasnt buzzed anymore!!
