Salvia Divinorum and Driving

SWIM is planning on smoking salvia tomorrow in his car. He is NOT going to be operating the vehicle while doing this, but parked on the side of the road in a residential subdivision with the engine off. SWIM is wondering if anyone knows the legality of this. For instance, if a cop were to catch SWIM smoking the salvia in his car, examine the substance and determine it is salvia, would SWIM be committing some kind of crime? Should he find a safer place to smoke?

SWIM says that salvia is as legal as cigarettes to smoke in michigan so there shouldn't be a problem. other than cops mistaking it for weed.

Hopefully no cops will pass by your car when you are in salvia land. They will probaly most likely assume you are on some sort of illegal substance and bring you in for at least a drug test.
Even when you pass it, your pipe probaly would get confisacted and not returned ><
Chances of that happening are probaly very low though I would imange.

If swim remembers correctly............the most important thing is where the keys are!

SWIY can definitely smoke salvia legally and in the car, but if the cop can gather evidence that swiy was planning to drive, that could be a DUI. Make sure the keys are not in the ignition (an excuse like....swim wanted the radio on,...probably won't fly well.

The DUI laws basically say that swiy can't drive while on something that impairs swiy (except it's worded more articulately). SWIM's heard stories of people getting arrested for DUI under paint fumes, and has heard stories (and knows people) who were drunk and listening to the radio (but not driving)..and got a DUI.

Basically, if swiy just follows the law....the cop can't do shit.

I agree with what you said Sal, would give +rep if I could. SWIM has just had bad experiences with police I guess.

Yeah, swim knows what swiy means.....swim's gotten caught for all kinds of random little things.....and it sucked even more because swiy didn't know his rights most of the time. Now it's a bit easier.

The cops in swim's town are mostly douchebags (some of them are really really nice)...but otherwise, they would use every trick in the book to cite swim if he was using sal.

For example, swim doesn't even think it's legal for a cop to take swiy's pipe if only sal was smoked out of it (but they'd most likely take it anyway, or convince swiy that they could). Good thing Salvia is more of an indoor drug anyway (well, depends, sometimes out in nature is great....but mostly away from lots of people), that way swim already stays out of trouble.
