I have heard about a long list of plants that would have been banned in LA. Does anyone know more about this?

Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana.

CONTROLLED SUBSTANCES: Prohibits the production, manufacture, and distribution of hallucinogenic plant products

AN ACT 1
To enact R.S. 40:989.1, relative to controlled dangerous substances; to create the crime of the unlawful production, manufacture, distribution, or possession of a material, compound, mixture, or preparation intended for human consumption which contains a hallucinogenic plant; to provide for definitions; to provide for penalties; to provide for exceptions; and to provide for related matters. Be it enacted by the Legislature of Louisiana:

Section 1. R.S. 40:989.1 is hereby enacted to read as follows:
§989.1. Unlawful production, manufacture, distribution, or possession of hallucinogenic plants

A.
(1) It shall be unlawful for any person knowingly or intentionally to produce, manufacture, distribute, or possess with intent to produce, manufacture, or distribute a material, compound, mixture, or preparation intended for human consumption which contains a hallucinogenic plant.

(2) Whoever violates the provisions of this Subsection shall be sentenced to 15 a term of imprisonment with or without hard labor for not less than two years nor more than ten years and may, in addition, be sentenced to pay a fine of not more than twenty thousand dollars.

B.(1) It shall be unlawful for any person knowingly or intentionally to possess a material, compound, mixture, or preparation intended for human consumption which contains a hallucinogenic plant.

(2) Any person who violates the provisions of this Subsection shall be sentenced to a term of imprisonment with or without hard labor for not more than five years and may, in addition, be sentenced to pay a fine of not more than five thousand dollars.

C. For the purposes of this Section:
(1) "Distribute" means to sell, lease, rent, barter, trade, furnish, supply, or
otherwise transfer in exchange for anything of value a material, compound, mixture, or preparation intended for human consumption which contains a hallucinogenic plant.

(2) "Manufacture" means the production, preparation, propagation,
compounding, or processing of a material, compound, mixture, or preparation intended for human consumption which contains a hallucinogenic plant either directly or indirectly by extraction from substances of natural origin, or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis. Manufacturer includes any person who packages, repackages, or labels any container holding a material, compound, mixture, or preparation
intended for human consumption which contains a hallucinogenic plant.

(3) "Production" includes the manufacture, planting, cultivation, growing, or harvesting of a hallucinogenic plant.

(4) "Hallucinogenic plant" means any part or portion of any of the following:
(a) Brugmansia arborea.
(b) Amanita muscaria.
(c) Conocybe spp.
(d) Panaeolus spp.
(e) Psilocybe spp.
(f) Stropharia spp.

(g) Vinca rosea.
(h) Ipomoea violacea.
(i) Datura spp.
(j) Pancreatium trianthum.
(k) Kaempferia galanga.
(l) Olmedioperebea sclerophylla.
(m) Mesembryanthemum spp.
(n) Virola spp.
(o) Anadenanthera peregrina.
(p) Anadenanthera colubrina.
(q) Erythina spp.
(r) Genista canariensis.
(s) Mimosa hostilis.

D. The provisions of this Section shall not apply to the possession, planting,
cultivation, growing, or harvesting of a hallucinogenic plant strictly for aesthetic, landscaping, or decorative purposes.

Proposed law retains the provisions of present law and creates the crime of unlawful production, manufacture, distribution, or possesssion of a material, compound, mixture, or preparation intended for human consumption which contains a hallucinogenic plant.
Proposed law defines "production", "manufacture", and "distribute" and "hallucinogenic plant".

Proposed law provides penalties for unlawful production, manufacture, distribution, or possession with intent to manufacture, produce, or distribute a material, compound, mixture, or preparation intended fo r human consumption which contains a hallucinogenic plant of imprisonment with or without hard labor for not less than two years nor more than 10 years and may, in addition, be sentenced to pay a fine of not more than $20,000.

Proposed law provides penalties for unlawful possession of a material, compound, mixture, or preparation intended for human consumption which contains a hallucinogenic plant of a term of imprisonment with or without hard labor for not more than five years and may, in addition, be sentenced to pay a fine of not more than $5,000.

Not at all,while this will stop some people from shipping i think this will have as little effect as outlawing spores did in cali. people will still continue to ship whatever they want. if john doe ships some criminal item from wherever into cali theres little that can be done to detect it and even less cali can do to prosecute someone thats not in there state short of extridition from another state in the us,and even that would probably never happen IMHO.

SwiM heard about this. Tsk tsk.

Soon smiling and food is going to be illegal. Instead of food, we will have little capsules we swallow and anybody caught smiling will be arrested on the spot. Possession of happiness will be a crime. You will not pass go. You will not collect $200. You will go directly to jail, and it'll cost more than $50 to bail yourself out.

At that time, we will all have barcodes in our hands that allow authorized retailers to access our credit (basically built in credit cards), and no longer use paper money so there is no way to buy anything tax-free.

If somebody wants to smoke some salvia, they should be completely in the right to do so. None of the plants really caused any problems down there (nobody tripped on salvia and ran in front of a car and got hit that swiM heard of), yet they still decided with NO RESEARCH to ban these plants because they all bear the label 'psychoactive'. All the meanwhile they drink their alcohol, smoke their cancer sticks and eat chocolate cake.

Fuck that. That is corruption.

Pot and MDMA both are banned essentially because they make people happy. MDMA quite literally. The reason that despite its illegality its usage rate has been steadilly INcreasing, is because people are starting to understand that they are really trying to ban happiness. The fact that we can put happiness in a pill is both a surprise and natural wonder to humans. People spend their entire lives seeking for happiness through fame, money, knowledge, and many other routes. The concept of that same feeling being given from a pill is quite astounding to think about, especially for those who have never rolled before. SwiM's god could not grasp the concept of how it could do that until she experienced it for herself for the very first time, and she will tell it to the bees that it was magical.

Now they are banning any plant that they think can cause happiness.

Besides kaempferia g. having cinamaldyhyde in it why the hell would they ban something like this? Oh god please dopnt tell me that is the only reason...

Heh, and pepper...that's next on the list, we're no longer going to have any pepper or any spices. All of our food is going to taste like shit because they want to take away all hints of happiness.

They can't go around banning every single chemical that will ever cause a potential to get high. It is illogical. We won't have anything left.

Btw Tennessee did not ban the plants, only Salvia. They changed the bill.

Yeah, getting "stoned" off the endorphine rush from spicy thai or indian food is such a threat to our society. Soon there'll be a ban on apple pie because lord knows everyone needs a good ol' pie fuckin here and there.
