I gotta go to court on Feb. 9th for a probation violation.Last October I skipped my report because the night before that I was too busy doing a half ounce of coke and the day I was supposed to report I was still railing it up so there was no way in hell I could go.So I havent reported since and now I got the papers sent to me telling me I got a show cause. What the hell am I supposed to do? My offense was just a mip of alcohol so it was nothing too seriously but do you think they will throw me in jail or set another court date up for sentencing? I dont have a record except for the mip but I'm seriously stressin here since I just got back with my girlfriend and I dont want to go to jail.

Although I have no info on this, I know one thing for sure: make sure, you go into that courtroom well-prepared! Search the net, call any infoline that may have answers. Know which cards to play.

Try this:

Yeah, well this was back in September.I was way out of control then but now I'm just startin to get my life back together and I dont want to start it out in jail! I was seriously thinkin about skipping court but then I'd be running for life. And Oakland county jail is not a place you want to be in!

Sands,I wasnt planning on doing coke all damn night cuz I knew I had to report the next day but when ya got a half ounce sitting in front of you,you dont think about those things.I never had to drop so I wasnt worried about that, but my p.o. would have definitely noticed I was wired.

I'm just gonna go and face the music, see what happens.

Freeyayo,

[The following post is just opinion and does not in any way constitute (nor is it offered as) legal advice.]

Ah, shit, man!

Okay, here you go (most of this you probably already know.):

1.) Come to court in good clothes & clean shaven.

2.) Dump any piercing and cover any tattoos.

3.) Get a haircut. Be willing to do whatever it takes to look clean-cut.

4.) Don't stink! Have enough mind to use modest cologne.

5.) Tell the judge that you got caught-up in a video game with a pretty girl. Tell him you weren't yourself. things happened. ...intimate things.

The prosecutor will want names. Don't give her (you know, the girl you were with) name. Remember, you're the noble boyfriend, so remain silent. Be willing to go to jail for your conviction because you might, anyway.

7.) Apologize to your parole agent for violating terms of your release (Bureaucrats love it when you prove them right). Then;

8.) Apologize to the judge for wasting his time and the states money in the proceedings against you.

9.) Offer to do what ever it takes to regain the confidence of the court, ANYTHING, then do it.

10.) Make sure your attornee is aware of this stratagy

and if you are represented by P/D take more initiative as they may be all too willing to accept any plee.

You don't need to follow this in the order it was listed, but you get the idea.

Just limit your bullshit in court, and come with your head hung low. You're the only one there with something to lose so act like you know it.

Be mindful of three things:

a.) Prison cells cost money..

b.) Bureaucrats want promotions and...

c.) Money across the country is tight

... and the best way that you can get a light sentence is through non-confrontational acquiescence to institutional authority.

Like I said, they love it when you make them look good.

Good luck.

Freeyayo,

The judge has heard every story people can think of. He probably has heard thousands of different storieswhy they missed reporting to their probation officer. Talk to your lawyer, stay as close to the truth as you can, bring your girlfriend there if you can. Let the judge know you have a girlfriend, a job, and when you missed your October date to report you became frightened that you would go to jail, lose your girlfriend, and your job. Judges are trained to spot liars, they go through courses on body language and courses on how to know when people are lying. Instead of saying you took coke, you might want to say you got drunk and since you were busted for alcahol, you panicked and failed to show up. That is almost the truth and you would be able to keep up the story if questioned in different ways without having to make things up as you go. When you talk to the judge, look him in the eye andbe sincere, eye contact means alot.

You can getdozens ofopinions, all probably different, all sounding pretty good, but the best advice is to talk to your attorney and be as truthful as you can. The only thing I wouldn'tmention would be the coke,I would probably change it to alcahol.

As much as you think you've prepared yourself for telling a lie, they mayask youquestions you didn't prepare for and like I said there trained to spot lies and liars.

One other thing, just hope the judge had some the night before and is in a good mood. LOL Hope everything works out for you.

Thanks for all the advice fellas.I just have a feeling they're gonna throw my ass in jail though.I have no job(legit),dont have all the money to pay off my probation fines and costs, havent completed any community service work, and I still have to go through the Victims Impact class.I'm hoping they just extend my probation instead of incarceration,if not I'm just gonna flat out tell them I have a drug problem and I need rehabilitation instead.Once again thank you all for the support and compassion that I recieved in these hard times I'm going through.

Hi. Just report, and when you do have a clean system so you can pass a piss test. An MIP isn't that big of a deal to a judge- shit, in my town that's usually book and release and it's a small town!!!! For not reporting, you may do up to a month. A month in county is nothing. (Where I'm from) I've done the same type of shit you did before, the drugs were there and I wanted to get high. f**k the timing. So don't feel like you did the worldest stupidest thing, or let anyone put you down cause you partied before an appointment. The most you'll get in my opinion is 30 days in county. Forgive me if I am wrong because I don't know all the particulars. If you want to go to re-hab instead of jail, be honest. Most people prefer any program over jail. You could just say you have a drinking problem, though. Beware if you get into rehab, upon your release piss tests will probably follow. Just face this sh^t, though. Your girlfriend will write, visit, and support you wherever you go. Seriously though, where I come from 30 days TOPS. Good Luck.

This is a rough county jail though close to the murder capital of the world.heh

I got all the money to pay off my fines and costs,so I'm thinking I wont go to jail right then.

And also when I got the MIP,Ihad no prior record and they still gave me a year probation,30 hours community service, and I have to attend this Victims Impact class. My girlfriend got an MIP in a totally different county and only had to pay a$150 fine and no probation. That's some bullshit.

Yeah I guess you could say it went pretty good. The judge ordered me to serve 18 days in jail or do 9 consecutive WAM(some work program)weekends. But I got a day taken off of each $25 I paid towards my fine,so lucky for me I had all the money so now I only have to do that work program the next 2 weekends then I'm done.I'll be off probation and everything,so thats definitely a good thing. So it looks like I'm here to stay!

Freeyayo,

That's VERY good news.

Now watch out for cops because if you ever get pulled over for anything, they'll run your ID and find this information. That's cool, though. As long as you know what they know, you'll know how to talk to them.

I hope your saturday party was good (have a feeling the next one's gonna be a blast.). What are your plans, now?

I wonder if I'm still allowed to cross into Canada with a misdemeanor conviction on my record? I know felonies are a definite no-no but is it ANY kind of criminal record or what?

Hey wood I feel alot better knowing if I ever get pulled over I don't have to use an alias.Glad I got this taken care of now. I just have to complete these work programs then I'm done.I was almost tempted not to go.I had 400 bucks in my hand and the dealer was in the back of my mind! Nah,I'm not THAT stupid.

My plans now are to hold this job that I just got and save up enough to put a security deposit down on a place.Kick my habbit and finally have something to live for.But in the meantime, just trying to have fun and stay out of trouble!
