Quick ?... Any Help Appreciated (USA)

So SWIM took a bunch of xanax the other night and after a night of little drinking was found passed out over his steering wheel at a red light while his car was in gear....the police had to break out one of SWIM's windows to get inside and assist the unconscious driver... instead of being taken to jail, SWIM ended up in the hospital because of SWIM's altered state of mind. When SWIM woke up in the hospital, there was no police officer and SWIM was released....my question is, even though SWIM wasnt taken to jail, will he still be charged with a DUI? There was no accident involved and on the medical records there was no blood alcohol level recorded, however a drug test was preformed and showed opiates, marijuana, and cocaine....whats swim lookin at here? SWIM appreciates any advice

No, SWIM is waitin to get the incident report from the police station as it was closed today and will be tomorrow because of the holiday

Look at your summons where it says something along the lines of "Offense."

It says DWI, DUI, OWI, OUI, or something along the lines of that. Look at the laws in your State and see what the maximum punishment is.

On a side note dont you think that was pretty dangerous to drive like that? Hopefully you dont do it again.

I dont know if you can read or not, but maybe you should read the first post again..... it says S.W.I.M., not me.... i am askin advice for a friend because I am a member here and he is not, i figured someone may have had a similar experience and could let me know what he is looking at.... thanks tho

A few years back SWIM(really not me) was on his way to get more drugs, when all of a sudden a river jumped in front of him. SWIM was found about an hour later passed out in his car by the cops. SWIM got 5 years probation and a suspended lisense(sp?). This was only one of numerous DUIs.

SWIY should be thanking his/her deities that nobody was injured. SWIY seems reckless and should consider psychotherapy. I've heard that enrolling in drug rehabilitation programmes can help minimize legal consequences. SWIY could obtain police contact information and write to them from a rehab facility. It'll probably be good to be able to tell the court SWIY self-admitted themselves for treatment.

SWIM already went through rehab. 2 times. Currently SWIM is in a 12 step program.

well if no summons has been issued i would NOT go to teh police asking for info,sometiems they loose paperwork/interest maybe they thought you had a legitiment medical condition? maybe they couldent get copies of your drug test results? probably not a good idea EVER to talk to police it cant help anything.

SWIM contacted a lawyer and its getting taken care of... thanks for the help tho guys, and yes for the record i think it was a very dangerous and stupid thing to do
