UK - Not driving, not in possession but high and stopped?

If you are stopped by police when clearly high (I'm thinking mainly XTC here) what can they do? Does it give them some sort of right to search you? If they don't find anything (say you've already taken them all) what can they do? I know they can't actually arrest you for anything but can they treat it similar to drunk and disorderly or something and stick you in cells for the night?

I've always assumed at worst they stick you cells for the night to 'sober up' then that's that but really I have absolutely no idea.

They cant hold you for the weekend the max amount of time is 24 hours any longer then they have to have a good reason and to ok it with a judge, unless it a serious crime you have commited as they are likely to put you on police bail. If your high and on foot, as long as your not causing a public nusiance there is little they can do, they may still search you though.

If you seem totaly out of it they probably wii take you to a hospital or to the station where a doctor may visit, just to make sure yours and others saftey.

Ah okay cheers. Sorry I didn't mean while driving. I just meant out on about on foot. Swims been on many missions at strange hours of the night to buy cigarettes and such while still at the peak. God knows what the people selling him the fags thought haha.

As for stopping you on foot, yea they can stop and search you, but as said, if you're not causing any problems with threatening behaviour, shouting and swearing or otherwise caught committing a crime, then there isn't much they can do. They can't arrest you for taking a drug, even if you admit you smoked a joint or even injected heroin 30 seconds before they arrived, then there is nothing they can do. They can be bastards though so just be polite, calm and talk to them normally, as soon as you get defensive then they can be pricks and take you in for any number of made up bullshit, but then you will get released without charge if you don't resist or anything like that.

There is realistically very little they can do as long as you are not making a nuisance. If they stop you and search you for example, then submit to the search. If they are to hold you in custody which theoretically they can, ask them 'what has caused you to be reasonably suspicious of criminal behaviour?'
