sentencing cap?

SWIM was offered count 1 30 months all but 90 days suspended w 2 years probation
on count 2 90 days concurrent w count 1 or if I would prefer a "cap" offer it would be 3 years all suspended but 6 months w/ 2 years probation. what is the difference in a "cap offer" is it to swims benefit or not? Also was offered 15 months straight time. Any lawyers out there or ppl who have dealt w the law help me? thanx

Sounds like you were offered 6 months in jail with two years probation with a three year back up. Does that sound familiar? If thats the case then if you violate your probation 15-20 times (which is how many times it takes to get rolled back) then you could be sentenced to prison for three years.

Just a guess. I wouldnt take that as being what you were offered. Verbage varies from jurisdiction to jurisdiction.

Talk to your assigned lawyer or your chosen lawyer. Laws vary from state to state and even within states between counties. You should talk to someone considered a "local professional" on the subject.

On another note, I am sorry to hear about your situation...t'is a truly sad thing.
I was curious if swiy would be willing to give out the details around there arrest. If swiy has not yet been sentenced or to court...it may be best to hold on to this until swiy knows it can't be used against them in this same case...but if LE already knows the details, maybe your story can help other swimmers avoid similar mistakes and situations?

I was arrested for marijuana before...1 oz of some plant that grows out of the ground, and I was treated like the scum of the earth and branded a criminal...spent 12 hours in a detention center b4 a judge even tried to see me...then they gave me a phone call...but only to local numbers and since I was an out of state student this was very frustrating esp since when I'd tell the guards they'd be like "tuff luck"...

one phone call my ass...

anyways, am just trying to say maybe be more careful in the future and maybe look at
Barry Cooper's video to be safer in the future.
