here's the situation:
person A and person B get together 3-5 days a week to smoke marijuana together before school. technically, the paraphinelia is person A's, but person B took it all to school with him that day (stupid idea in the first place, i know.) persons A and B are enrolled at the same school, but person A attends a trade school in place of the high school. person A is a minor, person B is 18. long story short; person B gets busted. told police it wasn't his but didn't mention any names. cops bribe person B to snitch on local dealers to lower his "trouble" (for lack of better term). nothing is said yet, but person B's parents are talking to an attorney tomorrow. person B calls person A today to tell him/her that he may have to actually tell who's paraphinelia it really is. person A is not a dealer, but a chronic smoker. person A does not have any paraphinelia or drugs right now, but could not pass a drug test. person A gave person B a name of a local mushroom harvester (only because that person betrayed person A). person A has been in trouble for stealing and distributing hydrocodone (felony), but was not caught at the time, and was not convicted but it is written on police records i guess. person B has never been in any trouble, but this current situation is a misdemeanor. what i'm asking is: can person A get into any trouble? if so, how? or why not? personally, since person A wasn't the one who got caught, i don't see how he/she could get in trouble. sry if i incuded tmi or useless info, i just want all the circumstances evaluated and the most unbiased version of the story. thanks for reading plz reply these ppl need ur help ASAP. |

I don't think person A could get in trouble if they weren't caught doing anything since it would be one person's word against another. There would have to be substantial evidence, search warrants, etc. In the end, law enforcement probably wouldn't want to waste so much time and money over something pretty small like this. A lot depends on state laws and such. It is best to consult a lawyer first because it could save both parties a lot of problems.
SWIM was arrested last February for posession of something harder and the officers tried intimidating this person into reveal the source of the drugs. More often than not, snitching won't help you unless you can really drop the bomb on a big operation. SWIM simply told the officer "No, I won't tell." and the officer said he had to respect that decision. Because SWIM never had anything more than a speeding ticket, the judge allowed this person to bypass probation for a fee. All in all, work with a lawyer to get the case going and person B might be able to get a lighter sentence. Good luck! |

I imagine the charge is possession of drug paraphernalia. Whoever possessed it is guilty.

Just dont admit to anything as its just your word against theirs and even if the stuff is yours, that fact that the other person got caught is not your fault.
They where in possesion of the material at the time and they where stupid enough to take it to school, not you. So it shoudnt be your problem, id just keep a clean house to be safe. As for drug tests, why should you have to submit to one. No one caught you with anything, so unless there is some hard evidence id would say no to any tests and id just play it cool. |

drug paraphenalia charges in most states are tantamount to a traffic violation. take the slap on the wrist. refuse probation, the punishment will almost certainly be a fine, which is far preferable to deferred adjudacative probation(if they havent offered this to you, they most likely will at some point)....where one would have to give a sample every week for up to 6 months.

Person B got in trouble. He must man up and accept the trouble that has befallen him, for surely it was him that got caught, and he was not framed, right? Since they have no trouble in the past, their sentencing should be rather light. Rolling over on Person A will do nothing for Person B. Police will say whatever they can to get their next criminal.

i heard person A admit he/she was just freaking out when it first happened. i'll post an update if anything crazy happens, but rumor has it person B is getting let off easy. this state has decriminialization, too, which helps. they really appreciate your time reading this and replying!
