Sued for assault

What excuses would you give the court if you were charged with assault?

Is verbal abuse and disrespectful behaviour by the victim enough to justify SWIMs actions and reduce punishment?

If SWIM does not have a pattern of violence, or a violent crime on his record, what punishment will he get? Is it common to go to jail for assault or do majority of cases involve a ticket/fine?

There is no permanent damage to victim, nothing broken, only bruises and cuts, and no weapons involved.
