PORTUGAL: On 1 July 2001 the law decriminalising use of drugs enters into force.(22/06/2001)
The Law 30/2000, adopted in November 2000 and modifing the main Portuguese drug law n: 15 of 1993, introduces for the first time in Portugal a regime of decriminalisation of use and possession for all illicit drugs. This law enters into force six months after its adoption following the establishment of the new Anti-Addiction Commissions (in Portuguese: Comissues para a dissuasco da Toxicodipendencia) in charge of dealing with minor drug related offenders.
The new law prioritises treatment interventions for all those people that are caught in possession of illicit drugs by the Police. Individuals possessing up to 10 daily doses of a classified substance for their personal use will be brought in front of the new Commission, which will have as its main concern the assessment of the health of the person - drug addicted or not - and as its main objective to provide for the latter's support, in terms of therapeutic treatment or counselling. The Commission, composed of three members (most probably a lawyer, a doctor and a social assistant) will always have the possibility of imposing a fine between 5.000PTE (25 Euro) up to the minimum national salary. However, as the main objective of the new system is the treatment and the subsequent rehabilitation of the individuals, fines will not be the main instrument to be used.
