Another absurd example of our legal system

Quote:
NASHVILLE, Tenn. -- A Bonnaroo concertgoer slapped with penalties under the state's illegal substance tax is suing state officials for what he says was overtaxing of his marijuana-laced Rice Krispies treat.William J. Hoak claims in his lawsuit that his "rice creeper treat" was taxed based on the weight of the entire treat -- which included cereal, marshmallows and other ingredients -- not just the marijuana. He has been fined $11,506 in taxes, interest and penalties by the state's Department of Revenue for the treat, according to the lawsuit."It's not like it was a pan of Rice Krispies treats like your mama would bring you," said Jonathan A. Street, Hoak's Nashville lawyer. "It wasn't a large amount of Rice Krispies treats. These taxes are just really high."

People arrested for possession of illegal drugs are taxed based on the weight of the drug. People can avoid being fined for tax evasion by anonymously buying stamps from the Revenue Department to be affixed to the drug's packaging. But possession of the drugs are still against the law, Street said."It's the penalties for not getting these stamps beforehand that really costs people who get arrested," he said. "Who in their right mind is going to go into a state building and purchase stamps for theirillegal drugs? I'm sure they haven't sold any of them."Hoak specifically names Loren L. Chumley, former commissioner of the Tennessee Department of Revenue and Paul G. Summers, the former attorney general, in his lawsuit.
I can tell you why arrests were down at Bonnaroo this year. They stopped arresting people for posession, and instead fined them hundreds of dollars, using this tax law. I've heard horror stories of the cop taking whatever swim had on then, leaving them to fend for themselves with no money in their pocket.
