The Declaration of Independence states it as this; "That to secure these rights, Governments are instituted among Men, deriving their just Powers from the Consent of the Governed." What rights are those? "We hold these Truths to be self-evident, that all Men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness." So we are entitled to liberty. And the constitution names other rights the government may UNDER NO CIRCUMSTANCES EVER take away from the citizens. These rights (in my case) include the right to own property (specifically named in the 5th amendment as something that cannot be taken away without due process of the law), unlimited right to contract (use whatever resources I have available to me - my time, energy, and rightfully gained property), and less tenuously, the right to think and believe as I see fit (1st amendment). Drugs for recreational purposes are just another path to follow in the pursuit of happiness - if you want to extend it that far, and are thus protected AGAIN. Anyway - the right to property and liberty- unalienable rights (i.e. you CANNOT give them up). All I am being tried for is the ownership of property and using my liberty/right to contract in order to sell my property. As the constitution was created NOT to grant rights - but to SECURE them from the government EVER taking them - the government is at fault here. Not me. Title 21 of the Federal Code are regulations for the Food and Drug industry. They are not crimes (others argue against this... it's irrelevant anyway...). Title 18 of the Federal Code defines crimes. The only job that is illegal FEDERALLY is shipping dentures - under Chapter 89, section 1821. http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=browse_usc&doc... This is the ONLY occupation or profession that is ILLEGAL at the Federal level. That doesn't interest me. What interests me are two different CRIMES listed in the Federal Code. U.S. code Title 18 (crimes) Chapter 13 (Civil Rights) sections 241 and 242. 241 is "Conspiracy against Rights" 242 is "Deprivation of Rights under Color of Law" http://www.access.gpo.gov/uscode/tit...hapter13_.html I am being punished for exercising my CIVIL and HUMAN rights of PROPERTY AND CONTRACT. These actions are NOT a crime - nor can they EVER BE a crime under the Constitution of the United States of America. PERIOD. The crimes are being committed by the government. You are being persecuted under the drug laws as well. Your liberty is GONE because of the drug laws. You won't stand up for your rights... Why? |

This is all very well, but governance rarley works like that. Public acceptance of a proposal is more politicaly important than it being constitutionaly correct - much like religion, apologists will always find ways of interpreting clear and otherwise exact statements as meaning something wholly other than what they would naturaly mean. So long as both the government and the general public want something the Supreme court can ride rough-shod over the constitution to get it by wholly twisting the original meaning. One thing that always puzzled me is why alcohol required a constitutional ammendment to prohibit, whilst drug laws are not embedded in the constitution and yet considered constitutionaly valid. I would suspect that, even if the supreme court found that it was unconstitutional there would still be enough political pressure to simply make an ammendment. Americans are still very close to banning basic liberties like flag desecration through constitutional ammendment, so it wouldn't be a great stretch to imagine that they would simply ammend the constitution if needed.
