USA - Is it legal to purchase Amanita Muscaria mushrooms?

I wanted to know if it is illegal for my neighbor to purchase spores or some other form of fresh Amanita Muscaria mushrooms for his fairy-themed garden. My neighbor has told me he has found websites that offer such deals but he wonders of their legitimacy and there legality in NY,USA. He does not intend on ingesting these mushrooms if that makes a difference.

With this strain (as opposed to others!) it should be relatively easy to obtain and if there is no consumption or selling (though consumption is "kinda" legal i suppose) you should be A ok.


I know of a great site, but its against the rules of the forum to give such information (so i won't until i hear its ok).

basically my advice is to just research a few different websites and go with one that is professional and replies to your questions and concerns.

It shouldn't be TOO expensive so let your friend know he shouldn't be that scared.

I am not at all sure that A. muscaria can be cultivated. I believe it has a symbiotic relationship with certain trees.

Possession of the spores of psilocybe mushrooms is illegal in the states of CA and GA. Obviously, this does not pertain to A. Muscaria.

its legal in the UK as they are not covered under the misuse of drugs act or any other legislation.

You could, in theory be prosecuted under poisons legislation for selling them if it was not made clear what they were and the dangers involved.

I like the way in which the law bans none toxic fungi but allows the possession for extremely toxic and potential fatal fungi. If there gona ban things shoudnt it be the other way round.

While "the law" can often be amazingly stupid, I believe in this case the distinction is practical. Only a very tiny percentage of people taking A. muscaria would ever repeat the experience, thus there is little incentive to ban it.

The only part of the U.S that I know of that has Amanita Muscaria controlled is Louisiana, but even that excludes growing and cultivating them for "aesthetic" purpouses. They are completely legal in New York and most of the world, except for a couple of places like Israel. When all forms of psilocybe mushrooms were put under Class A in London, Swim tells me that where they were that instead of psilocybe mushrooms, Amanitas are now quite common.
