Cannabis and DUI

Since weed doesn't show up on a breathalizer test, can you be incriminated for driving while high, if you can pass all of the stupid tests they give you?

SWIM was wondering because the other night, he was heading home but saw a sobriety check point on the highway, and he was very, very lit at the time, so he swerved onto another road to avoid it.

If SWIM had stayed on the highway, obviously baked out of his mind, would he have been arrested, or would they have been looking for drunks instead?
