Ordering Salvia to Louisiana
I believe it's illegal for sale for human consumption in Louisiana(USA), however companies sell it on the net. Would it be illegal for swim in Louisiana to buy Salvia online?

Good question. SWIM suspects that in Louisiana they would.
I was going to edit my last post, but for some reason I am unable to edit right now. Anyhoot, what I was going to edit was that it's not just the fact that it's a scheduled drug like I stated, it's the fact that it's now a schedule I drug in Louisiana. |

These guys are in Alberta, Canada. It is illegal to buy, possess, sell etc. salvia in Louisiana if intended for human consumption. But not for collection, aethetics, cultivation(gardens and such). Some mod said an online company willing to sell to swim in Louisiana is breaking the laws, but swim called them and they said it wouldn't be breaking the law.
I would have brough this up in my last thread, but some moderator locked my thread. Why? I have no idea. |

I think the moderator did that because you asked about salvia being legal in Louisiana, and I think we pretty much covered the subject completely. The moderator did not do anything wrong man.
Like the moderator stated in that thread concerning how any online vendor who was willing to sell to you in Louisiana would likely not be a quality vendor, I would have to agree with what the moderator said. I'm not saying that this vendor you found is not legit, but from SWIM's experience, most of the better vendors have disclaimers about not sending salvia to Louisiana, and most of the better vendors are not interested in a one time customer, they really want repeat customers. But the law clearly states(at least on the link on Wikipedia) that it is illegal IF intended for human consumption. Swim wants to buy it for aesthetic purposes. Is this still illegal?

Clearly, then, it is not illegal if you are buying it for aesthetic purposes, as the law allows.
It is also very understandable if a vendor is unwilling to sell to anyone residing within Louisiana. The vendor wants to stay as far away as possible from anyone who could even potentially use his products illegally - this is to cover his own ass. Also, discussion of sources is strictly not allowed on these forums. A moderator will see this thread soon enough and change the title. Remember this in the future. I can appreciate what you're saying, but the rules are usually in place to protect the members.
SWIM is a moderator at another website, and it's been SWIM's experience that it's usually just the new members who find the rules to be too many, or too restrictive. Speaking from SWIM's own experience, forum rules are usually in place to help and protect the members, and not to restrict the members. anyways...from the actual bill..... A.(1) It shall be unlawful for any person knowingly or intentionally to 12 produce, manufacture, distribute, or possess with intent to produce, manufacture, or 13 distribute a material, compound, mixture, or preparation intended for human 14 consumption which contains a hallucinogenic plant. It says only about human consumption, so it is legal to buy if not for that purpose. Also, it's important to notice that the bill just says "salvia divinorum" the plant is illegal. Threads merged and reopened. I guess there is still more to discuss apparently.
And while there may be a good amount of rules to keep in mind acidfrk, they are important to keeping the forum in working order with the best quality information possible and keeping the community free of any legal problems that could occur. Just take care posting as you start out, and you should get the hang of them in no time. Here is the law currently in place in Louisiana regarding Salvia Divinorum ----> legis.state.la.us/billdata/streamdocument.asp?did=318544 Now while you could have the plant, having an extract would be a bit trickier. Louisiana # Effective Aug 8, 2005 (signed into law Jun 28, 2005) Louisiana Act No 159 makes 40 plants illegal, including S. divinorum, when intended for human consumption. The law specifically excludes the "possession, planting, cultivation, growing, or harvesting" of these plants if used "strictly for aesthetic, landscaping, or decorative purposes." Having extract for purposes other than consumption is hard to explain to authorities, because leaves would be better in any scenario SWIM assumes.
And extract is basically just more potent leaves, so it is definitely still possessing the plant matter. SWIM agrees with Bajeda, SWIM doubts that the police of Louisiana will show disgression, or the courts. Keep in mind that it would probably be shipped to SWIY's home without notice, and once it's in SWIY's place, the police would have a hard time getting in and arresting SWIY cus of all SWIY's rights. Anyways, SWIM thinks it's best to just ask a policeman (preferably one away from SWIY's home and without stating SWIY's name). Or a lawyer. Peace. Sal-A |

Fuck em. SWIM is just gonna order it. SWIM thinks the police have bigger fish to fry than someone ordering a gram or two of a plant that was just illegalized relatively recently. Plus its for aethetics, don't cha know!

Well, if you want to get really technical, I belive if swiy does get arrested and charged with intent to sell, ect, sense the DEA has not made this a controlled substance a query of peers could remove the charge. The question then lies in how good is your lawyer in picking out the query?
Some websites will still sell to states where it is illegal to distribute Salvia Divinorum, and they get away with it by slaping on the package: not for human consumtion, hehehe. As long as they are selling standerised salvia, they probaly aren't trying to scam you with less Sal-A then they claim. Doing a google search on reviews on any site before purchasing is usally a good idea though. |
