The federal government is actively violating the 10th amendment, by not recognizing the medical marijuana laws of states that have approved marijuana for medical use.

The Fifth amendment allows you the right to not incriminate yourself. By registering with your state as a medical user of marijuana and/or a medical provider of marijuana, you are adding yourself to a list that does incriminate you to the federal governments laws against marijuana.

Therefore, it is the 5th amendment rights of every american that lives in a state that allows medical marijuana to reject the "official" registration process on the ground of not self-incriminating themselves; but continue to use and/or provide medical marijuana as the rest of the law states is allowed.

Now, don't take this as case-law yet ... but it's a defense that may be brought forth and examined soon.
