Man gets year in prison for conspiring to sell date rape drug
March 29, 2007 NEW HAVEN, Conn. --A Norwalk man was sentenced to one year and one day in prison for conspiring to sell a substance commonly used as a "date rape" drug, federal authorities said Thursday. Donald Davis Jr., 41, was sentenced Wednesday in U.S. District Court in New Haven after pleading guilty last September to one count of conspiring to distribute gamma butyrolactone. In May 2005, officers executed a search and arrest warrant at Davis' residence. Officers seized several firearms, firearm ammunition, narcotics paraphernalia, and significant quantities of GBL stored at the residence, authorities said. Officers also seized Davis' personal computer. A subsequent search revealed that Davis had used the internet, including a bulletin board called "The Global Connection," to facilitate sales of the "date rape" drug, authorities said. Davis was ordered to forfeit $80,000 |

That seems like an very light sentence for GBL prosecution compared to the sentences I have seen come down since Webslinger. I bet Daniel Pelchat would plea bargain for 366 days in a heartbeat.

1.25 L ? That's 4 months worth for the moderate user! What would anyone get distributing that! Sounds like there's a frame around this guy's mugshot. Extortion is a good choice of words. Wonder what got the guy searched in the first place ?
1 year and $80 K is not a light sentence for something which could be bought at a hardware store not so many years ago. Maybe there's more to the story but somehow SWIM doubts it ? |

Here's my belief: Since the USPS and Customs were involved according to the article, I believe they did a controlled delivery to the guy who ordered it online and had it shipped to his house. Armed with the controlled delivery search warrant, they seized his computer and also found Oxycodone in his house.
I do not believe for one minute he was distributing GBL OR oxycodone, but I believe they used consipiracy to distribute both items as leverage to get him to accept a plea bargain. It is extortion, as plain as the nose on my face. Every one of the law enforcement officials involved should be treated as Gestapo thugs for such tactics. |

Hey why bother spending money on real police investigations when you can sit your fat cop ass on a chair and tap in a few ping queries to bust someone for a victimless crime.
Smoke and mirrors people, we really got one bad-ass prom queen rapin' monster off the streets - before he even commited the crime! Time to score me some donuts. |

Doesn't simultaneous posession of guns and drugs increase the severity? Heard about cops using this technique to get someone to snitch on his brother (bad guy--murdered wife). He was just a recreational pot user, but owned a hunting rifle. (From one of my ma's "real crime" shows--doubt I could track down a link).

Generally, the use of a firearm in any crime upgrades the crime automatically to a felony and carries a 5 year minimum sentence. In this case, I noted that they are starting to push the "possession of a firearm" during the commission of an unrelated felony. So they are moving away from the use of a firearm in the commission of a crime and moving toward possession of a firearm during the commission of a crime. It's more DA bullshit to increase the initial charges, demonize guns and give the charged party more time to try to plea down. It literally is everything and the kitchen since come at you these days. In the US now, anyone who is an addict of or user of illicit drugs is in the same class as a convicted felon and can not hold professional licenses, etc. It's an all-out war ON Americans.
