Heads up
Hi id just thought id let you know that swim is attending his police interview for the importation of cact chips (class A drug) in a coulpe of days.
Originaly the police told him that his brother woudnt need to return for interview because swim signed a form and said in interview that everything found in his room had nothing to do with him. The police said that it would be unlikely they would want to see him again. But they still they still do which I think is a good sign because it means they are fishing for more information and probably have a weak case against swim. Swim will keep you all informed. |

Re: Heads up
Well the police have put swim back on bail till the 8th of jan. They still insist that cacti chips are class A drug. I still think otherwise. So the wait goes on, but i think this is gona take a year or so

Re: Heads up
Cactus chips may or may not be class A drugs, but what does that have to do with SWIDib? Did he admit to having ordered them? Did the cops find any evidence suggesting so? Did the cops find any corroborating evidence in SWIDib's house?
If not, there is no connection between SWIDib and the package sent by mail. Advice: never admit to anything and never talk to cops without a lawyer present. |

Re: Heads up
They intercepted swims mail with swims addy and name on there so there is now of denying it. Not that swim would anyway as they are/where perfectly legal. Swim has had packages opened before, its only now the police have decided to test the law.

Re: Heads up
It is possible that intercepted mail might not be admissible as evidence in court. Also, any statements or admissions SWIDib has made might also be discarded as evidence under certain circumstances. Consult an attorney with experience in drug cases.
Cops talk a lot of shit in the hope of scaring people into confessing. Almost always they have much less evidence than they claim they have. Usually most of the evidence they claim does not exist and some is not admissible in court. Since this is a first regarding the prosecution of cacti in the UK, do not underestimate the lengths they will go in order to set a precedent. Also do not underestimate the danger you are in just because you are innocent. That might not save you from going to jail. Nothing will substitute talking to a lawyer with EXPERIENCE in drug cases. You would also do well to try to get involved any civil rights organizations you can. They might be responsive since this is a precedent-setting case. For starters check out http://www.cyber-rights.org/ regarding your encrypted data and e-mails. Good luck! |

Clam up and be safe.
Dib claims: "They intercepted swims mail with swims addy and name on there so there is no ... denying it."
Not so. Whenever a Cop asks you a question, you do not have to answer. In an import-problem situation, just because it's mailed to you, means nothing. Anyone could have ordered it in your name. Say, an ex-Wife wants to stick-it to ex-Hubby, etc. In MOST criminal cases, the Cops don't have enough evidence to arrest, if the "criminal" doesn't admit to doing it. When you rat on yourself, it can (and will) be used against you in court. If a Cop arrives at your door, just slam the door in his face. This is perfectly acceptable. Say nothing, admit nothing (5th Amendment). Well, the good news is, you will find-out first-hand, if chips are legal. |

If people could be prosecuted for receiving something in the mail you could send some dope to anyone you don't like and have them shipped off to jail. Even if something WERE obviously true (which it isn't) you would have nothing to gain by incriminating yourself. And a lot to lose, because their evidence may be not enough for a conviction, but your confession will surely be enough. If SWIDib has already made admissions they probably can be discarded if he denies them in court (made under duress? in the absence of an attorney?) If you are under arrest you have the right to an attorney for free. And if you are not under arrest you have NO OBLIGATION to talk to cops at all. |

That being said, keeping one's mouth glued shut is good advice whether you're facing 5-Oh in Milwaukee or Timbuktu. I do not know how much leeway LE is given in the UK these days to use tactics of persuasion or outright lies, but if above advice is used, then LE tactics are moot point. LE in both places have a history of using less-than-savory tactics when fighting what they consider "a war". In the US, I point to Gitmo as an excellent example of this. In the UK one is simply reminded of the Guildford 4. Both previous posters have given good advice...... Someone around here should be able to get you in touch with a civil right organization in the UK. Probably best if you can get the interest of one that doesn't have any agenda with regards to changing drug policy. And although you may desire to stand on the SODDI defense (Some Other Dude Did It), the rules regarding affirmative defense in the UK might require your attorney/barrister to take a different approach. Get thee to an experienced attorney - |

Re: Heads up
Well I think its hard slamming the door on a cop when 15+ bust your door in at 5am in the morning saying ill destroy your lives, screaming where is the money or drugs.
This case probably will make case law, what make it worse is that I could order the exact same thing from about 100 head shops located within the uk. The police are aware of there sale but they refuse to shut them down until this case is resolved. |
