SPRINGFIELD -- Gov. Rod Blagojevich signed into law Thursday a bill banning the sale of the pure form of a drug commonly found in over-the-counter cough medicines.

The law would make illegal to sell, possess, deliver or distribute dextromethorphan, known as DXM, unless it was obtained through a prescription or an over-the-counter medicine, such as Robitussin, which contains acceptable doses of the drug, Blagojevich said.

The law, which takes effect immediately, arose from the September 2003 death of an Illinois State University student who overdosed on DXM bought in pure form over the Internet, according to a statement from the governor's office.

"The idea that kids can go on line and easily get their hands on a dangerous drug is appalling," Blagojevich said.

DXM, used to get a high or feel hallucinogenic effects, also can cause confusion and dizziness to vomiting and rapid heart beat, according to the Partnership for a Drug-Free America Web site. DXM is also known as "skittles," "robo" or "Triple C," the partnership site said.

So, because some kid got pure DXM over the internet and thought he could take the entire bag people aren't allowed to control their cough in Illinois. Anyone see anything wrong with that?

^ How is is that people can't control their coughs? Prescription and OTC preparations with DXM are unaffected by this legislation. I don't think very many, if any, of the people who've bought pure powdered DXM are using it for cough medicine.

Isn't this all a rather moot point? I was under the impression that there were no sources left for bulk DXM powder anyway. Wasn't at least one company raided after this death occured? I may be wrong - I've no interest in DXM so I don't keep up on its availability.

SPRINGFIELD - Buying or selling the pure form of a drug known as DXM will be illegal in Illinois under a plan that Gov. Rod Blagojevich signed into law on Thursday.

Greg Frary of Peoria, who with his wife, Linda, had lobbied for the new law, said it was "a real thrill" to learn of the governor's action.

Their son, Jonathan Frary, died in September 2003 from what authorities ruled was an accidental overdose of dextromethorphan hydrobromide. The 22-year-old Illinois State University student, a psychology major, had a particular interest in dream research and apparently thought that DXM would enhance his dreams, Linda Frary told lawmakers earlier this year.

He was able to buy the drug legally on the Internet, according to his parents.

In e-mailed comments Thursday, the Frarys called the newly passed law an important one.

"Our hope is that this will spare other Illinois parents the agony of losing their child to this dangerous drug," they wrote.

They added that they would like to see similar legislation passed either at the federal level or in each of the other 49 states.

Dextromethorphan, or DXM, is an ingredient in some cold and cough medicines. The pure form, a white powder, acts as a hallucinogen.

The new law, which takes effect Jan. 1, 2007, will make possession of the pure form of DXM a Class 4 felony, generally punishable by up to three years in prison. Selling or distributing pure DXM will be a Class 2 felony, generally punishable by up to seven years in prison.

"The idea that kids can go online and easily get their hands on a dangerous drug is appalling," Blagojevich said in a news release. The new law will help to stop that, he added.

The measure sailed through the General Assembly this year as House Bill 4300. No one in the Senate or House voted against it.

Sponsors of the legislation included Reps. Chapin Rose, R-Mahomet; Dan Brady, R-Bloomington; and David Leitch and Aaron Schock, both R-Peoria; as well as Sen. Dale Risinger, R-Peoria; and Sen. George Shadid, D-Peoria.

DXM will become a 'street' drug, because people will be able to buy it in bulk, legally, in other states,
and then go to Illinois and sell it for ridiculous prices on the street.

DXM is still readilly available people just don't know where to look

SWIM told me that DXM is fun for a while but is not something to be done a lot
its definately not for everyone, just like every chemical
quite frankly SWIM is very happy most of the DXM sources have closed down now along with the RC sources, people misuse these drugs and get it taken away from everyone else

Darn! I had a bad feeling that it would involve expensive equipment, a PhD. in biochemistry, or at very least, illegal precoursors. I guess this means we'll all have to switch to Ketamine if DXM is made illegal.
