USA- Legal Status Of Mephedrone, MDPV & Cathinones / Bath Salt Bans

I have fallen behind with maintaining the map and chart. Pennsylvania and I'm sure a few other states have passed bans, and I think a couple more go into effect on July first- I will try and get things updated soon but for now consider this at least a month or two out of date.

MDPV, mephedrone, Methylone, – Methoxymethcathinone, 3- Fluoromethcathinone, and 4 – Fluoromethcathinone, are all banned now in florida. Since thursday jan 27th.


Thismorning the Florida Attorney General Bondi put an ‘Emergency Control’ on the ingredients in drugs sold as ‘bath salts’. they did this in the same manner as the DEA and the ban of JWH chemicals (k2 smoke), a hastily made report with little to no real facts about what they are banning. Just read it-

RULE TITLE: RULE NO.:
Addition of 3,4 – Methylenedioxymethcathinone (Methylone),
3,4 – Methylenedioxypyrovalerone (MDPV),
4 – Methylmethcathinone (Mephedrone),
3 – Methoxymethcathinone, 3- Fluoromethcathinone,
and 4 – Fluoromethcathinone, to Schedule I, Subsection 893.03(1), F.S. 2ER11-1


SPECIFIC REASONS FOR FINDING AN IMMEDIATE DANGER TO THE PUBLIC HEALTH, SAFETY OR
WELFARE:
In written findings published on the date this emergency rule was filed with the Secretary of State’s
Office, Attorney General Bondi has found that there is a need to immediately place the above-mentioned
compounds commonly known as “bath salts” under Schedule I, Subsection 893.03(1), F.S., in order to curtail the
abuse of “bath salts” by Florida’s children and young adults. These circumstances present an immediate and
imminent hazard to the public health, safety, and welfare which requires emergency action. In addition the
Attorney General has found that the above-mentioned compounds meet the statutory criteria for placement as a
controlled substance in Schedule I, Subsection 893.03(1), F.S.
REASONS FOR CONCLUDING THAT THE PROCEDURE USED IS FAIR UNDER THE CIRCUMSTANCES:
The above-mentioned compounds commonly known as “bath salts” present an immediate and imminent hazard to
the public health, safety, and welfare which requires emergency action. The Attorney General will ask the Florida
Legislature to memorialize this action through legislation in its 2011 legislative session. The Attorney General will
immediately begin rulemaking procedures if the Legislature fails to act. A copy of the Attorney General’s findings
in support of this emergency rule may be obtained by contacting the Office of the Attorney General, PL-01, The

Now check out what the Florida AG said about it:


“It makes you think you’re seeing monsters and it also makes you think that you can fly and there are a lot of balconies out there,” Bondi said at a hastily called news conference.”

True that.. looks like someone had a bad time.

Bondi issued a 90-day emergency order that went into effect immediately. It makes the sale or possession of the drug a third-degree felony punishable by up to five years in prison. That’s the same penalty as for similar crimes involving cocaine or heroin.

DAMMIT! SWIM hates that this is happening, but it's inevitable once a drug gets popular and is involved in overdoses/side effects. But methylone? Has anyone even died from that in the history of...EVER?! It's not even on the DEA "Chemicals of Concern" list.

Wonder how this will affect vendors? So far, none that SWIM has seen have refused to send these "bath salts" to customers in the aforementioned states. Anyone heard whether any bans are pending in Nevada?

So does this mean that various research chemical companies will NOT be sending out the above-mentioned materials, say to Florida, for example? I agree with you Lady Codone, it was only a matter of time before such a precious material like Arlone (Methylone) went up for it's turn on the chopping block. Let's hope the 2C's aren't next....

I have been trying to follow this closely since the unfollowed through December 24th ban. Most merchants of incense and bath salts around this area pulled them from the shelves quickly and kept them under the counter for weeks after, unknowing of what was going on and what products were effected. The dea's page gives little detail of future actions. I was even on it Feb. 27 and read nothing of the jwh ban going officially into effect. Good idea for a thread. It may be benefical to many to post any reliable information heard of future bans or meetings of the subject by state officials.
If only there was a way to hit the brakes of this wheel in motion.

I apoligize for the clutter. I was simply stating that it's nice that there's a thread on the topic. It was quite confusing for some after December 24th. Thus, keeping updates and documented links for terms is a good idea.
There I go again, rambling and making clutter.

"February 22nd, Alabama became the 5 state to ban chemicals due to this recent bath salt stir up. Unlike Florida, which had banned 5 chemicals likely to be in most bath salts, Alabama went straight for the kill (IMO) by banning both Methylenedioxypyrovalerone and Mephedrone.
"These two chemicals are deadly and cause tremendous health issues," Deborah Soule, executive director of Alabama's Partnership for a Drug-Free Community. "They pose a threat to the well-being of young people and anyone who uses them."

Can anyone verify or refute some of the chatter swim's little sugar glider has been hearing? Swim's pet sugar glider is confused as to if the said materials are actually scheduled, or being suggested for a scheduling.

^^ they are not scheduled federally, though the feds are persuing an analog act prosecution of a mephedrone vendor and the state of Tennessee is pursuing a unique prosecution of mephedrone based "bath salts".

More and more states are banning mephedrone and MDPV, as well as a few others.

There has also been talk from the Drug Czar, Congress, and the President regarding these chemicals. At best- their days are numbered, and the legal risks associated with them are greatly increased.

I must say, the local corner store up the street has been quite busy these past couple of nights. The owner told me people started freaking out about 4 days ago because they couldn't find bath salts anywhere else and he sold out his stock that night. Tonight he was stocked up plenty, with a smile and a fat pocket.

Tonight I decided to check up on some Mephedrone and MDPV vendors online, and many sites were either sold out or not taking orders at this time. I wonder were this rumor or leak is coming from. I can't seem to find anything reliable in writing on the web.

IT"S ALL GOING TO BE OVER SOON!!!!WV is on its way to banning to SALE of "Bath Salts" Doesn't say anything in the article about the USE of Bath Salts. I haven't been able to find the bill on line.

CHARLESTON WV-On Saturday March 13, the West Virginia Legislature approved a bill that makes buying or selling bath salts a misdemeanor. It's now waiting on acting Gov. Earl Ray Tomblin's signature.

Many states lack information - there appears to have been no statewide action taken but I can't guarantee it. There may also be local bans in place in some locations.

Lack of state prohibition does not mean the substance is fully legal and may be prosecutable under a number of existing laws.

I will miss them as a Floridian. But I can see a bit of Bondi's reasoning. The news this morning carried an awful story where a visibly drunk man leaving a liquor store hit a curb, went two-wheel sideways, "just like the clown riders at the monster truck shows," said witness Wee Willy Hillbilly, ran over a gaggle of nuns killing entire gaggle, he was then so shaken he dropped his hot coffee and bourbon from his hand to his lap. It was at this point, he jumped the median and hit a convoy of school buses heading to the Space Center tour.

In all another 712 children were killed. Many were even revived and had to die a second time.


But folks, theres a reason we tel y'all come to Florida on vacation and leave on probation. Aint nothing against you Texas Rangers state police with your pretty little garden hats on, but Florinda ranks second to NONE in LE at the highest levels. A very sharp Tallahassee detective found an invoice for plant food in the subjects car.....He was on a trip to BUY MEPHEDRONE!!!!! If I had black and white film and some old super 8 camera I'd scare all you kids right with an informative accurate documentary like "Methylone Madness"

As of Monday they ban will go into effect in Oregon. State board of Pharmacy voted Wednesday. They also made permanent the temporary ban on synthetic cannabinoids.

On April 15, 2011 the board filed emergency rules (WSR 11-09-044) to ban the chemicals used in “bath salts” These products are most commonly known by names like Ivory and Purple Wave, Red Dove, Blue Silk and Zoom and are a form of synthetic cocaine and methamphetamine-like substances. The emergency rule also continues a ban adopted on January 7, 2011 for synthetic cannabinoids (marijuana), most commonly known as Spice or K2. The board’s actions classify these products as Schedule I controlled substances.

The rule adds fluoromethcathinone (flephedrone), methylmethcathinone (mephedrone), methylenedioxypyrovalerone (MDPV), methylenedioxymethylcathinone (methylone), methylbenzodioxolylpropylamine (butylone), JWH-018, JWH-073, JWH-200, CP-47,497, and cannabicyclohexanol to the list of Schedule I controlled substances.

The rule was effective immediately and remains in effect for 120 days. In addition, the board will begin the rule process for evaluating the need to include these chemicals in permanent rules.

Schedule I substances have a high potential for abuse and no accepted medical use. The rule makes it illegal to sell, possess, manufacture and deliver these chemicals or products containing these substances. New Jersey Division of Consumer Affairs enacted a ban today:

General Paula T. Dow and Thomas R. Calcagni, Acting Director of the State Division of Consumer Affairs, today announced an Order of the Acting Director to ban the manufacture, distribution, sale, and possession of so-called "bath salts" drugs.

Effective immediately upon the signing by Acting Director Calcagni on Wednesday, the Order adds six chemicals associated with so-called "bath salts" drugs to the list of Schedule I Controlled Dangerous Substances in New Jersey.


The Order of the Acting Director lists the following chemicals as Schedule I Controlled Dangerous Substances in New Jersey:
▪ 3,4 – Methylenedioxypyrovalerone (MDPV)
▪ 4 – Methylmethcathinone (Mephedrone, 4-MMC)
▪ 3,4 – Methylenedioxymethcathinone (Methylone, MDMC)
▪ 4 – Fluoromethcathinone (Flephedrone, 4-FMC)
▪ 3 – Fluoromethcathinone (3-FMC)

The Missouri ban has passed both houses and is awaiting the governors signature. Seems some counties/cities in the states have or are considerring their own bans- which may be more restrictive then the state law.

The Florida ban making the emergency scheduling permanent has passed.

Numerous counties/cities/towns in Pennsylvania have passed bans, and the state ban is moving forward rapidly.

The state of Illinois is getting close to banning it also- This appeared in the Chicago Tribune this past week:

"At the Capitol, both the House and Senate have approved separate measures outlawing MDPV and its derivatives. Sponsoring Sen. Jacqueline Collins said the Alton death shows the need to quickly get her bill to Pat Quinn's desk."

The funny thing about Illinois is the following - which is true-
"State lawmakers routinely pass get-tough bills that generate headlines, but enforcement is key. The Tribune reported Sunday that recently outlawed novelty lighters are still being sold despite the danger to children who may mistake them for toys. The state fire marshal said his office needs stronger enforcement authority."

I have updated the status in both the chart and the map for at least a half dozen states.

I still need to *confirm* status in a few states with pending legislation, as well as try to track down info on the "unknown" states.

Should be noted there has been a rash of "local bans" in a number of states, so as always it is up to the individual to research the laws in their particular area.

EDIT Updated chart and map again to add info on proposals in 2 previously unknown states, and a note on 1 other.

Maryland had two bills introduced (to control mephedrone, mdpv, bk-pmma, 4-fmc, 3-fmc methylone) but both died after "unfavorable readings by judiciary committee". and I see no action since mid march. I can find no information on other bans pending.

Nevada's proposal is stalled and I am unable to find info on exactly what stopped the process.

Reports are the the NY Department of Health, under state health commissioner, Nirav Shah, announced an emergency ban yesterday. I can not find a press release on their site, and can not yet confirm which "bath salt" chemicals were banned. Anyone able to dig up the facts?
