David McNally was found dead at a house in Truro by David Pugh in March 2004. Pugh, 22, of Quintrell Road, Newquay, earlier admitted supplying Mr McNally with heroin. Elaine McNally told the court: "My heart goes out to him for what he has suffered." Pugh was ordered to do 100 hours unpaid community work. Pugh said he had noticed his friend had overdosed, put him in the recovery position and intended to keep watch, but instead he fell asleep. When he woke up Mr McNally was dead on the sofa. Mrs McNally had asked to be allowed to address the court. She told Judge Jeffrey Rucker: "I do not think he should suffer any more. To wake up and find your friend dead is punishment enough, my heart goes out to him for what he has suffered." Defence counsel Simon Laws said the death of his friend had had a tremendous impact on Pugh's life. Judge Rucker said that the culpability of his offence did not justify a prison sentence.
