I cant seem to find this bit of information anywhere. Does anybody know the punishments for each of the levels of drug felonies and misdemeanors in New York? Does anybody know the punishment for growing magic mushrooms also in New York? If nobody knows the answers to these questions do you know a website that does? |

I dont memorize them statute by statute but I do have first hand experience.First,the following applies to N.Y.C.only...Possesion of even heroin is a misdemeanor punishable by up to a year of jail.In reality,you wont be jailed unless you rack up 3 or more convictions within a short period of time[a year is a good rule of thumb].If you do get misdemeanor time chances are that you will receive less than 90 days[which equals less than 45 actual days in jail]. On sales...Sale of weed is a misdemeanor except[thanks to a recent law]when racking up 3 or more convictions within 1 year,then it is enhanced to a felony which as a first time drug felony will equal at least time served up to probation,usually a combination of both.All other sales[of small amounts] equal the marijuana felony penalties.If you rack up a second offense[for the same thing]within 10 years you can bet on 1 and a half to 3 years upstate. With higher amounts you face more severe penalties[for sale and possesion].Ever hear of the Rockefellar Laws?That is life without parole[at the worst level]. |

Every State has State run libraries!
Go to your nearest State library. Ask your librarian how to reference State statutes (laws); they're probably issued at extended intervals (3-6 years) with paperback abridgments as revisions to existing law in previous publication. They do this because laws change after each legislative session, and instead of reprinting the entire set, the State usually prints an accompaniment of amendments that have been applied after the most recent legislative session. These are often referred to as "Revised" statutes. You might find it titled as "New York State, Revised Statutes" If you must, explain to the librarian the specific area of criminal law that you wish to reference. I'm sure the librarian can help you. |

What worked for me was looking up lawyers on the Internet, I found one, e-mailed my questions, and I got a response promptly. There was no fee. Try this before you hit the books. (Unless research fascinates you) If you are specific in your question, they can give you a very specific answer. If you can't find one and you're desperate, post again. Maybe if I'm here I'll try to find one for you. I can give you some free legal advice though- using is a lesser crime than selling. Keep it all in one bag, even if it's one Glad trash bag. (J.K.) |
